Chapter 9.5Southern California Veterans Cemetery
Section § 1410
This law outlines the process for establishing a state-run Southern California Veterans Cemetery in Orange County. The Department of Veterans Affairs, along with the Department of General Services, will study, acquire, and build the cemetery. A site for the cemetery must be examined to meet specific criteria.
Eligible individuals for burial include honorably discharged veterans, their spouses, and eligible children, according to federal guidelines. The Department will set a fee for burying veteran spouses and children that reflects the cost. Money from these fees goes into a special maintenance fund.
Section § 1412
This section allows local government entities in Orange County to collaborate on creating a Southern California Veterans Cemetery. All funds for the cemetery's study, development, and equipment will be held in a special state fund, with spending approved by California's Legislature. Local entities and private donors can contribute to a second fund for feasibility studies on proposed sites. Once enough money is available, the department may study site feasibility, examining costs, legal issues, and federal requirements. After the study, any leftover funds will go back to donors if requested or will reimburse state costs. Separate funds handle cemetery maintenance, with expenditures also subject to legislative approval.
Section § 1414
If someone wants to build, place, or donate a monument or memorial at a cemetery in Orange County, their proposal must first be reviewed by a special committee. This committee includes the cemetery administrator, local government reps, and veteran organizations. After the committee review, the secretary has the final say on approval.
The department will also set up rules to guide how these monuments and memorials are proposed and approved, as per another section (1418).
Section § 1416
This law allows the cemetery administrator to accept donations of personal property and cash for the Southern California Veterans Cemetery. These donations can be used for the design, construction, maintenance, beautification, or repair of the cemetery, or to reimburse state expenses for these purposes. Cash donations are deposited into a special fund specifically for the cemetery. Most of the money in this fund can be used continuously for maintenance and beautification, as designated by donors and approved by the secretary. However, funds meant for initial design, construction, or reimbursing state expenses can only be used if approved by the Legislature.
Section § 1418
This law section says that the department has the authority to make rules to implement the chapter's provisions. These rules have to follow the process outlined in the Administrative Procedure Act, which is a specific set of guidelines for establishing regulations.
