Section § 1330

Explanation

This law requires the Secretary of Veterans Affairs to set up a special committee to beautify and enhance the California Mexican American Veterans’ Memorial. The committee will consist of seven members: five chosen by the Governor, one by the President pro Tempore of the Senate, and one by the Speaker of the Assembly. The Secretary will also select one of the members to act as the chairperson of the committee.

(a)CA Military and Veterans Code § 1330(a) The Secretary of Veterans Affairs shall establish a California Mexican American Veterans’ Memorial Beautification and Enhancement Committee composed of seven members as follows:
(1)CA Military and Veterans Code § 1330(a)(1) Five members appointed by the Governor.
(2)CA Military and Veterans Code § 1330(a)(2) One member appointed by the President pro Tempore of the Senate.
(3)CA Military and Veterans Code § 1330(a)(3) One member appointed by the Speaker of the Assembly.
(b)CA Military and Veterans Code § 1330(b) The secretary shall appoint one member from the committee to serve as chairperson.

Section § 1331

Explanation

This law states that committee members will not be paid for their roles.

Members of the committee shall not receive any compensation.

Section § 1332

Explanation

This law allows the committee to ask for help and resources from the Department of Veterans Affairs for its activities. The department can provide the support and get paid back for the expenses.

The committee may request staff support and facilities for its activities from the Department of Veterans Affairs, and the department may provide that support and be reimbursed for the cost of this support.

Section § 1333

Explanation

This section states that the committee is in charge of fulfilling the objectives outlined in the chapter.

The committee shall be responsible for carrying out the purposes of this chapter.

Section § 1334

Explanation

This section authorizes improvements to an existing memorial on state property in Sacramento, specifically at a location bordered by Ninth, Tenth, L, and N Streets. The improvements must beautify and enhance the current memorial and surrounding area.

The funding for these improvements will come from private donations and existing funds managed by the California Mexican American Veterans’ Memorial Beautification and Enhancement Commission. The Department of Veterans Affairs can also accept donations for this purpose.

Before the California Mexican American Veterans’ Memorial Beautification and Enhancement Committee can start any construction, the Department of Finance must confirm that there is enough private funding available. Additionally, the committee must sign a state maintenance agreement to ensure ongoing upkeep with private funds.

(a)CA Military and Veterans Code § 1334(a) The beautification and enhancement of an existing memorial on state grounds is hereby authorized. For the purposes of this act, “state grounds” means that property in the City of Sacramento bounded by “Ninth,” “Tenth,” “L,” and “N” Streets. The actual site for the beautification and enhancement of the memorial shall be the site of the existing memorial and surrounding ground.
(b)CA Military and Veterans Code § 1334(b) Funds for the beautification and enhancement of the memorial shall be provided through private contributions and through existing funds collected under the auspices of the California Mexican American Veterans’ Memorial Beautification and Enhancement Commission. The Department of Veterans Affairs may receive contributions for this purpose.
(c)CA Military and Veterans Code § 1334(c) If the California Mexican American Veterans’ Memorial Beautification and Enhancement Committee undertakes responsibility to construct a memorial under this chapter, it shall not begin construction until the Department of Finance has determined that sufficient private funding is available to construct, enhance, and maintain the memorial, and the committee signs a maintenance agreement with the state, as created under subdivision (f) of Section 1335.5, to maintain the memorial with private contributions.

Section § 1335

Explanation

This section outlines what the committee can do regarding the design and construction of an enhanced memorial. They can set a timeline for the project's various stages and establish processes to collect and select design ideas. The committee is responsible for choosing fundraising and construction partners, overseeing the project's development, and planning a rededication ceremony. With respect to the design and construction of an enhanced memorial, the committee may do all of the following:
(a)CA Military and Veterans Code § 1335(a) Establish a schedule for the design, construction, and dedication of the enhanced memorial.
(b)CA Military and Veterans Code § 1335(b) Implement procedures to solicit designs for beautifying and enhancing the memorial and devise a selection process for the choice of the design.
(c)CA Military and Veterans Code § 1335(c) Select individuals or organizations to provide fundraising services and to construct the enhanced memorial.
(d)CA Military and Veterans Code § 1335(d) Review and monitor the design and construction of the memorial and establish a program for the rededication of the memorial.
(e)CA Military and Veterans Code § 1335(e) Consult with the Department of General Services to determine parameters for the final size of the memorial.
(f)CA Military and Veterans Code § 1335(f) Consult with and obtain final design and site orientation approval from the Department of General Services and the Secretary of Veterans Affairs.

Section § 1335.5

Explanation

This law section involves the design and building of an enhanced memorial by the Department of General Services, with input from a committee. They have to review the design plans to spot maintenance issues and ensure the memorial follows ADA guidelines and safety rules. They also need to check and approve environmental documents. Before construction begins, they need to finalize and approve all plans, secure necessary permits, and ensure everything is in place, including details about insurance and construction inspections. There's also a focus on creating a maintenance agreement for the memorial's long-term care, which covers aging, vandalism, or relocation concerns. Lastly, the department inspects the contractor’s work once construction starts.

With respect to the design and construction of an enhanced memorial, the Department of General Services, in consultation with the committee, shall seek to accomplish the following goals:
(a)CA Military and Veterans Code § 1335.5(a) Review the preliminary design plans to identify potential maintenance concerns.
(b)CA Military and Veterans Code § 1335.5(b) Compliance with the Americans with Disabilities Act of 1990 (Public Law 101-336) and other safety concerns.
(c)CA Military and Veterans Code § 1335.5(c) Review and approval of proper California Environmental Quality Act documents prepared for work at the designated state grounds.
(d)CA Military and Veterans Code § 1335.5(d) Review of final construction documents to ensure that all requirements are met.
(e)CA Military and Veterans Code § 1335.5(e) Preparation and attainment of the right-of-entry permit outlining the final area of work, final construction documents, construction plans, the contractor hired to perform the work, insurance, bonding, provisions for damage to state property, and inspection requirements.
(f)CA Military and Veterans Code § 1335.5(f) Prepare a maintenance agreement outlining the California Mexican American Veterans’ Memorial Beautification and Enhancement Committee’s responsibility for the long-term maintenance of the memorial due to aging, vandalism, or relocation.
(g)CA Military and Veterans Code § 1335.5(g) Inspect the construction performed by the contractor selected by the California Mexican American Veterans’ Memorial Beautification and Enhancement Committee.

Section § 1336

Explanation
The enhanced memorial should be designed in a way that doesn't favor any political viewpoint.
The design of the enhanced memorial shall be as politically neutral as possible.

Section § 1338

Explanation

This law section states that once the beautification of a certain memorial is finished, the committee must inform the Governor and the Secretary of Veterans Affairs. The legal rules governing this process will automatically end on January 1st of the year after this notification unless a new law changes or extends this end date.

The committee shall notify the Governor and the Secretary of Veterans Affairs when beautification and enhancement of the memorial pursuant to this chapter is complete. This chapter shall remain in effect only until, and shall be repealed on, January 1 of the year following that notification, unless a later enacted statute, which is enacted before that date, deletes or extends that date.
