Section § 1070

Explanation

This section defines key terms for the chapter. 'Department' refers to the Department of Veterans Affairs, and 'Home' refers to veterans homes located in specified California cities like Barstow, Chula Vista, and others.

For purposes of this chapter, the following definitions shall apply:
(a)CA Military and Veterans Code § 1070(a) “Department” means the Department of Veterans Affairs.
(b)CA Military and Veterans Code § 1070(b) “Home” means a veterans home located in Barstow, Chula Vista, Fresno, Lancaster, Redding, Ventura, West Los Angeles, or Yountville.

Section § 1072

Explanation

This section requires a department to create a yearly financial report for specific homes, starting by February 1, 2019. This report must include the state funds budgeted and revenue collected, expected future revenue, costs of care per resident, and both current and projected maintenance costs for each home. These reports must be submitted to the Legislature and published on the department's website for public access. The report was to be updated by February 1, 2020, and then annually.

(a)CA Military and Veterans Code § 1072(a) On or before February 1, 2019, the department shall submit to the Legislature and post in a prominent location on its Internet Web site in an accessible and searchable format a financial report that provides all of the following information regarding each home identified in subdivision (b) of Section 1070:
(1)CA Military and Veterans Code § 1072(a)(1) The amount of state funds budgeted to and the amount of revenue collected from the home.
(2)CA Military and Veterans Code § 1072(a)(2) The remaining amount of expected revenue from the home over a period of several years, as applicable.
(3)CA Military and Veterans Code § 1072(a)(3) Aggregate costs of care per resident, segregated by level of care, for the home.
(4)CA Military and Veterans Code § 1072(a)(4) Current maintenance costs of the home.
(5)CA Military and Veterans Code § 1072(a)(5) Projected maintenance costs for the home.
(b)CA Military and Veterans Code § 1072(b) The department shall update the report required by subdivision (a) on or before February 1, 2020, and annually thereafter. The department shall submit to the Legislature and post on its Internet Web site each updated annual report in compliance with this chapter.

Section § 1074

Explanation

This law requires the department to periodically review the use of veterans' homes to ensure they're being used in the best possible way without restrictions. They must create a report and share it with the Legislature and on their website. This report considers financial records, the needs of local veterans, future veteran population trends, available resources, and feedback from residents and the community.

Each home has a specific deadline for when their report is due, starting with Yountville in 2022 and extending to other homes through 2028. For any new home, the first report is due 15 years after it opens or is transferred to the department. These reports must be updated every five years.

(a)CA Military and Veterans Code § 1074(a) The department periodically shall review the use of each home to determine the best continued, unrestricted use of the home. The department shall submit a report to the Legislature regarding this determination and post it in a prominent location on its internet website in an accessible and searchable format.
(b)CA Military and Veterans Code § 1074(b) In developing the report, the department shall review all of the following:
(1)CA Military and Veterans Code § 1074(b)(1) Every financial report created pursuant to Section 1072 and released during the five previous years or since February 1, 2019, whichever is fewer.
(2)CA Military and Veterans Code § 1074(b)(2) Current needs of the regional veterans population.
(3)CA Military and Veterans Code § 1074(b)(3) Projections regarding the changing composition of the veterans population.
(4)CA Military and Veterans Code § 1074(b)(4) Assessment of resources available to serve the projected veterans population.
(5)CA Military and Veterans Code § 1074(b)(5) Input from veteran residents of the home, community members near the home, and other stakeholders.
(6)CA Military and Veterans Code § 1074(b)(6) Any other factors the department determines are necessary to review to make the determination.
(c)CA Military and Veterans Code § 1074(c) The report for each home shall be due in accordance with the following schedule:
(1)CA Military and Veterans Code § 1074(c)(1) The report for the Barstow home shall be due on or before December 31, 2026.
(2)CA Military and Veterans Code § 1074(c)(2) The report for the Chula Vista home shall be due on or before December 31, 2025.
(3)CA Military and Veterans Code § 1074(c)(3) The report for the Fresno home shall be due on or before December 31, 2028.
(4)CA Military and Veterans Code § 1074(c)(4) The report for the Lancaster, Ventura, and West Los Angeles homes shall be due on or before December 31, 2025.
(5)CA Military and Veterans Code § 1074(c)(5) The report for the Redding home shall be due on or before December 31, 2028.
(6)CA Military and Veterans Code § 1074(c)(6) The report for the Yountville home shall be due on or before December 31, 2022.
(7)CA Military and Veterans Code § 1074(c)(7) The report for any future home shall be due on or before December 31 of the fifteenth calendar year after the home admits its first resident or after the home is deeded to the department, whichever is later.
(d)CA Military and Veterans Code § 1074(d) The department shall update each report required by this section every five years. The department shall submit to the Legislature and post on its internet website each updated report in compliance with this chapter.

Section § 1075

Explanation

This law requires the department to evaluate how each state veteran home is used to ensure they remain beneficial and accessible. They need to consider how easily residents can access healthcare through the Veterans Health Administration. Additionally, they must assess how nonresident veterans nearby can access these medical services. The department should explore the possibility of establishing satellite medical clinics on the home campuses or within a 30-minute drive, in partnership with the Department of Veterans Affairs, to serve both residents and nonresident veterans.

When the department reviews the use of each home to determine the best continued, unrestricted use of the home, pursuant to Section 1074, the department shall additionally assess all of the following:
(a)CA Military and Veterans Code § 1075(a) The need by residents of state veteran homes in accessing care at a Veterans Health Administration medical center.
(b)CA Military and Veterans Code § 1075(b) The need by nonresident veterans in the communities where state veteran homes are located in accessing care at a Veterans Health Administration medical center.
(c)CA Military and Veterans Code § 1075(c) The potential for the Veterans Health Administration to place satellite medical clinics on the state veteran home campuses to serve both residents of the veteran homes and nonresident veterans in the communities where state veteran homes are located. In making this assessment, the department shall meet and confer with officials of the United States Department of Veterans Affairs on the possibility of locating satellite clinics on state veteran home campuses.
(d)CA Military and Veterans Code § 1075(d) The potential for the Veterans Health Administration to place satellite medical clinics within a 30-minute drive of a state veteran home campus to serve both residents of the veteran homes and nonresident veterans in the communities where state veteran homes are located. In making this assessment, the department shall meet and confer with officials of the United States Department of Veterans Affairs on the possibility of locating satellite clinics within a 30-minute drive of a state veteran home campus.

Section § 1078

Explanation

This law requires the department to provide each report mandated by this chapter to the Legislature, following the rules outlined in Section 9795 of the Government Code.

The department shall submit each report to the Legislature required by this chapter in compliance with Section 9795 of the Government Code.

Section § 1080

Explanation

This law clarifies that it does not permit sharing personal or medical information if the disclosure is otherwise restricted or prohibited by other laws.

This chapter shall not be deemed to require or authorize the disclosure of personal or medical information otherwise prohibited or restricted from disclosure.
