Section § 7650

Explanation

This law specifies who can inspect boilers and tanks in California. Inspections must be done by either certified inspectors or qualified safety engineers. If a manufacturer requests an inspection of their tanks or boilers, it must be done by the division's safety engineers. A certified inspector is someone with a valid certificate and is employed by a county, city, insurer, or employer (for inspecting their own equipment). A qualified safety engineer has passed a division-mandated exam and is trained to inspect these vessels according to specific construction rules.

Inspections required by this part shall be made either by qualified safety engineers employed by the division or by certified inspectors; provided, however, that shop inspections shall be made by the division, acting through its qualified safety engineers when request therefor is made by any manufacturer of tanks or boilers.
(a)CA Labor Code § 7650(a) As used in this chapter a “certified inspector” is one who is qualified to make inspections or examinations of boilers or tanks according to the rules under which the vessel is constructed, who has an unrevoked certificate of competency issued pursuant to this part, and who is employed by any one of the following:
(1)CA Labor Code § 7650(a)(1) A county.
(2)CA Labor Code § 7650(a)(2) A city.
(3)CA Labor Code § 7650(a)(3) An insurer.
(4)CA Labor Code § 7650(a)(4) An employer, for the purpose of inspecting only tanks and boilers under his jurisdiction.
(b)CA Labor Code § 7650(b) As used in this chapter a “qualified safety engineer” is one who is qualified to make inspections or examinations of boilers or tanks according to the rules under which the vessel is constructed. Such qualification is to be determined by a written examination prescribed by the division.

Section § 7651

Explanation

If you want to get a certificate that proves you are skilled or qualified in a certain area, you need to apply to the division responsible for it.

A certificate of competency may be obtained by application made to the division.

Section § 7652

Explanation
This law allows the division to assess whether an applicant is qualified to receive a certificate that proves their competency through an examination process.
The division may determine by examination the competency of an applicant for a certificate of competency.

Section § 7652.5

Explanation

This law states that a certified inspector who is hired by an insurer or employer to inspect only tanks and boilers doesn't need to be a citizen or a registered voter.

Notwithstanding any other provision of the law, a certified inspector employed by an insurer or by an employer for the purpose of inspecting only tanks and boilers under his jurisdiction need not be a citizen or an elector.

Section § 7653

Explanation

This law allows the division to revoke a certificate of competency if there is a valid reason to do so. The certificate can be taken away if the division finds a good cause.

Upon good cause being shown therefor, the division may revoke a certificate of competency.

Section § 7654

Explanation

If an inspector finds a serious hazard that could threaten employees' safety, they must report it to the division immediately, using telegraph or telephone, within 24 hours.

Inspectors are also required to submit a detailed report of routine inspections within 21 days using specific forms. Failure to do so could result in their certification being suspended or revoked.

Where serious conditions are found by certified inspectors that would jeopardize the life, limb, or safety of employees, the reports of inspection shall be made forthwith to the division by telegraph or telephone within twenty-four hours.
Within twenty-one days after each routine inspection, every certified inspector shall forward a report of his inspection, on prescribed forms, to the division. His certificate of competency may be suspended or revoked by the division for failure to comply with this section.

Section § 7655

Explanation

This law requires the relevant division to create and adopt safety regulations for setting up and operating facilities that store and dispense compressed or liquefied natural gas and liquefied petroleum gas into vehicles. These regulations must follow the rules outlined in the California Administrative Procedure Act.

The division shall prepare and adopt regulations in accordance with the Administrative Procedure Act provided for in Chapter 3.5 (commencing with Section 11340) of Part 1 of Division 3 of Title 2 of the Government Code, designed to promote safety with respect to the installation and operation of vendor facilities for the storage and pumping of compressed or liquefied natural gas and liquefied petroleum gas into vehicles.
