Section § 38550

Explanation

This law required the state board to figure out what California's greenhouse gas emissions were back in 1990. They had to hold public workshops to allow people to give feedback and use the best information from science, technology, and economics.

The goal was to set a limit equal to the 1990 level to be achieved by 2020, and this plan had to be approved in a public meeting.

By January 1, 2008, the state board shall, after one or more public workshops, with public notice, and an opportunity for all interested parties to comment, determine what the statewide greenhouse gas emissions level was in 1990, and approve in a public hearing, a statewide greenhouse gas emissions limit that is equivalent to that level, to be achieved by 2020. In order to ensure the most accurate determination feasible, the state board shall evaluate the best available scientific, technological, and economic information on greenhouse gas emissions to determine the 1990 level of greenhouse gas emissions.

Section § 38551

Explanation

This section states that California's limit on greenhouse gas emissions will stay in place unless the law is changed or removed. The California Legislature wants these limits to continue beyond 2020 to keep reducing greenhouse gas emissions. Additionally, the state board is responsible for advising the Governor and the Legislature on ways to further decrease these emissions beyond 2020.

(a)CA Health and Safety Code § 38551(a) The statewide greenhouse gas emissions limit shall remain in effect unless otherwise amended or repealed.
(b)CA Health and Safety Code § 38551(b) It is the intent of the Legislature that the statewide greenhouse gas emissions limit continue in existence and be used to maintain and continue reductions in emissions of greenhouse gases beyond 2020.
(c)CA Health and Safety Code § 38551(c) The state board shall make recommendations to the Governor and the Legislature on how to continue reductions of greenhouse gas emissions beyond 2020.
