Section § 1599.85
This law requires long-term health care facilities to include a clear notice on all admission contracts and advertisements. This notice must inform consumers they can contact the State Ombudsman’s Office for more information about the facility, and it should include a toll-free number.
Section § 1599.86
This law defines a 'contract of admission' as all the paperwork that a resident or their representative needs to sign when they are being admitted into a long-term care health facility. This is based on the definition found in another law section, Health and Safety Code Section 1326.
Section § 1599.87
This law requires the Department of Health Services to create a list of the 25% of long-term healthcare facilities with the worst records for violating laws or regulations. These facilities must include a specific statement on all their admission contracts and advertisements. The statement informs potential residents that the facility's record of citations is available at the facility and a copy can be requested from the Department of Health Services.
Section § 1599.88
This law requires the Department to create rules for implementing the Chapter. It includes a provision allowing advertisers to use one disclosure statement to meet legal requirements for all ads on a single page.
Section § 1599.89
This section states that if there are violations of this Chapter, the solutions or penalties are outlined in Government Code Section 12269.
