Section § 1599.85

Explanation

This law requires long-term health care facilities to include a clear notice on all admission contracts and advertisements. This notice must inform consumers they can contact the State Ombudsman’s Office for more information about the facility, and it should include a toll-free number.

Long-term health care facilities must prominently and clearly display the following notice on all contracts of admission, and all advertisements used to solicit consumers to enter into contracts of admission: “For more information about our facility, you may call the State Ombudsman’s Office at (insert toll-free number).”

Section § 1599.86

Explanation

This law defines a 'contract of admission' as all the paperwork that a resident or their representative needs to sign when they are being admitted into a long-term care health facility. This is based on the definition found in another law section, Health and Safety Code Section 1326.

“Contract of admission,” as used in this chapter, includes all documents which a resident or his or her representative must sign at the time of, or as a condition of, admission to a long-term care health facility as defined in Health and Safety Code Section 1326.

Section § 1599.87

Explanation

This law requires the Department of Health Services to create a list of the 25% of long-term healthcare facilities with the worst records for violating laws or regulations. These facilities must include a specific statement on all their admission contracts and advertisements. The statement informs potential residents that the facility's record of citations is available at the facility and a copy can be requested from the Department of Health Services.

The Department of Health Services (the Department) shall compile a list of approximately twenty  five  % (25%) of the long-term health care facilities with the most serious records of violations of laws or regulations by virtue of proven or admitted Class AA and Class A citations. Those facilities on this list shall include this statement on all contracts of admission, and all advertisements used to solicit consumers to enter into contracts of admission: “This facility’s record of citations is posted at the facility, and a copy may be obtained from the Department of Health Services.”

Section § 1599.88

Explanation

This law requires the Department to create rules for implementing the Chapter. It includes a provision allowing advertisers to use one disclosure statement to meet legal requirements for all ads on a single page.

The Department shall issue regulations to implement this Chapter, including permitting one disclosure to satisfy the requirements of Section 1599.85 for all advertisements on the same page.

Section § 1599.89

Explanation

This section states that if there are violations of this Chapter, the solutions or penalties are outlined in Government Code Section 12269.
