Section § 4965

Explanation

Before starting any projects or construction work, a district's leadership must officially announce their plan by passing a formal statement of intent.

Before a district acquires or constructs any works under this chapter, its governing body shall adopt a resolution declaring its intention to do so.

Section § 4966

Explanation

This law requires a detailed plan, called a 'resolution of intention', to be made before building or acquiring works. It must describe the work, refer to engineer plans, estimate costs, specify bonds to be sold, and outline the served area's details. It should estimate how many places will benefit and the revenue generated immediately and in the future. The resolution must state that revenue bonds will pay for the works. Lastly, it must provide notice to the community about when they can express concerns or objections to the proposed works and bond issuance.

The resolution of intention shall contain all of the following:
(a)CA Health & Safety Code § 4966(a)  A brief and general description of the works. If they are to be constructed, a reference to the plans and specifications that have been prepared and filed by the engineer chosen by the governing body.
(b)CA Health & Safety Code § 4966(b)  The estimated cost of the works to be acquired or constructed, and the amount of bonds to be issued and sold.
(c)CA Health & Safety Code § 4966(c)  A general description of the area to be served by the proposed works, referring to a plat of the area, which shall govern for all details.
(d)CA Health & Safety Code § 4966(d)  An estimate of the number and character of the places and properties to be served by the works, including those ready for immediate service and those in expectancy.
(e)CA Health & Safety Code § 4966(e)  An estimate of the immediate revenue that would be received from the operation of the works, and of future revenues in expectancy.
(f)CA Health & Safety Code § 4966(f)  A statement that revenue bonds of the district will be issued to cover the cost of the works.
(g)CA Health & Safety Code § 4966(g)  A notice of the time and place when persons interested may appear before the governing body and be heard as to any protests or objections they may have against the acquisition or construction of the proposed works and the issuance and sale of bonds.

Section § 4967

Explanation

If you own property that could benefit from certain construction or operational projects, you can ask the district to carry out the work. You don't have to include detailed descriptions or estimates in your request, but your request can't be turned down without a public meeting first.

The owner of property that may be benefited by the acquisition, construction, extension, or operation of the works referred to in this chapter may file with the district a request that a particular work be undertaken. The request may, but need not, include the descriptions and estimates referred to in Section 4966 and shall not be denied without a public hearing.
