Section § 12750

Explanation

This section defines important terms related to flamethrowing devices. A 'flamethrowing device' is described as any portable gadget meant to shoot a burning liquid at least 10 feet away. A 'permitholder' is someone who has a permit to own or use such a device.

For purposes of this part, the following definitions shall apply:
(a)CA Health & Safety Code § 12750(a) “Flamethrowing device” means any nonstationary and transportable device designed or intended to emit or propel a burning stream of combustible or flammable liquid a distance of at least 10 feet.
(b)CA Health & Safety Code § 12750(b) “Permitholder” means a person who holds a flamethrowing device permit issued pursuant to this part.

Section § 12751

Explanation

This law section explains that certain regulations do not apply to the handling of flamethrowing devices for specific individuals. If a person is employed by a fire department or firefighting agency and is using the device on duty as part of fire suppression activities, the usual restrictions on buying, selling, possessing, transporting, storing, or using flamethrowing devices do not apply to them.

This part shall not apply to the sale, purchase, possession, transportation, storage, or use of a flamethrowing device by a person if all of the following apply:
(a)CA Health & Safety Code § 12751(a) The person is regularly employed by or a paid officer, employee, or member of a fire department, fire protection district, or firefighting agency of the federal government, the state, a city, a county, a city and county, district, public or municipal corporation, or political subdivision of this state.
(b)CA Health & Safety Code § 12751(b) The person is on duty and acting within the course and scope of his or her employment.
(c)CA Health & Safety Code § 12751(c) The flamethrowing device is used by the fire department, fire protection district, or firefighting agency described in subdivision (a) in the course of fire suppression.
