Section § 39700

Explanation

This section states that having a strong research program is essential for any statewide plan to fight air pollution.

The Legislature hereby declares that an effective research program is an integral part of any broad-based statewide effort to combat air pollution.

Section § 39701

Explanation

The state board is responsible for organizing and gathering research data on air pollution. This involves studying several key areas, including controlling emissions from vehicles and other sources, understanding the science of the atmosphere, and evaluating the impact of air pollution on health and the environment. Additionally, they must develop tools and models to analyze these effects and investigate alternatives to practices like agricultural burning. They are also tasked with exploring different solutions to air pollution issues and identifying areas where more research is needed.

The state board shall coordinate and collect research data on air pollution, including, but not limited to, all of the following:
(a)CA Health & Safety Code § 39701(a)  Research relating to specific problems in the following areas:
(1)CA Health & Safety Code § 39701(a)(1)  Motor vehicle emissions control, including alternative propulsion systems, cleaner burning fuels, and improved motor vehicle pollution control devices.
(2)CA Health & Safety Code § 39701(a)(2)  Control of nonvehicular emissions.
(3)CA Health & Safety Code § 39701(a)(3)  Control of specific contaminants to meet ambient air quality standards.
(4)CA Health & Safety Code § 39701(a)(4)  Atmospheric chemistry and physics.
(5)CA Health & Safety Code § 39701(a)(5)  Effects of air pollution on human health and comfort, plants and animals, and reduction in visibility.
(6)CA Health & Safety Code § 39701(a)(6)  Instrumentation development.
(7)CA Health & Safety Code § 39701(a)(7)  Economic and ecological analysis.
(8)CA Health & Safety Code § 39701(a)(8)  Mathematical model development.
(9)CA Health & Safety Code § 39701(a)(9)  Trends in atmospheric quality throughout the state.
(10)CA Health & Safety Code § 39701(a)(10)  Alternatives to agricultural burning.

Section § 39702

Explanation

This law requires the state board to report to the Legislature whenever needed about issues related to managing air quality.

The state board shall report to the Legislature whenever it deems necessary to provide information on problems relating to air quality management.

Section § 39703

Explanation

This law states that the state board is in charge of managing and coordinating all state-funded air pollution research. The board's responsibilities include setting research goals, evaluating research proposals, suggesting which projects to start, awarding research contracts, setting up necessary administrative and review procedures, and gathering and sharing information about air pollution.

The state board shall administer and coordinate all air pollution research funded, in whole or in part, with state funds. In discharging its responsibilities, the state board has all of the following duties and powers:
(a)CA Health & Safety Code § 39703(a)  Establish applied research objectives.
(b)CA Health & Safety Code § 39703(b)  Receive and review all air pollution research proposals.
(c)CA Health & Safety Code § 39703(c)  Recommend the initiation of specific air pollution research projects.
(d)CA Health & Safety Code § 39703(d)  Award contracts for air pollution research projects.
(e)CA Health & Safety Code § 39703(e)  Establish the administrative and review procedures necessary to carry out this section.
(f)CA Health & Safety Code § 39703(f)  Collect, validate, and disseminate educational information relating to air pollution.

Section § 39704

Explanation

This law section states that when the state board is giving out contracts for air pollution research, it must consider how well the University of California and the California State University can lead a thorough research effort to address air pollution issues. The board should also assess the ability of these universities to use their campuses to support a comprehensive research program.

In awarding contracts for the conduct of air pollution research, the state board shall consider the capability of the University of California and the California State University to mount a comprehensive program of research to seek solutions to air pollution problems and the ability of those universities through their respective campuses to mobilize a comprehensive research program for this purpose.

Section § 39705

Explanation

This section outlines the establishment of a screening committee by the state board to review air pollution and climate change-related research projects. The committee can have up to 11 members, including experts like physicians, scientists, and engineers, with at least two members specializing in climate change. They assess and provide recommendations on research projects funded by the state. Committee members are paid $100 per day for attending meetings and also reimbursed for travel expenses.

(a)CA Health & Safety Code § 39705(a) The state board shall appoint a screening committee of not to exceed 11 persons, the membership of which may be rotated as determined by the state board.
(b)CA Health & Safety Code § 39705(b) The committee shall consist of physicians, scientists, biologists, chemists, engineers, meteorologists, and other persons who are knowledgeable, technically qualified, and experienced in air pollution problems for which projects are being reviewed. At least two members of the committee shall have demonstrated expertise in the field of climate change. The committee shall review, and give its advice and recommendations with respect to, all air pollution and climate change-related research projects funded by the state and subject to approval by the state board, including both those conducted by the state board and those conducted under contract with the state board.
(c)CA Health & Safety Code § 39705(c) The committee members shall receive one hundred dollars ($100) per day for each day they attend a meeting of the state board or meet to perform their duties under this section. In addition to the compensation, they shall receive their actual and necessary travel expenses incurred while performing their duties.

Section § 39706

Explanation

This law states that money collected and placed into the Air Pollution Control Fund is to be used by the state board for developing technology, like a heat exchanger, to dispose of the waste produced during cotton ginning, while meeting emission standards. The state board must talk with the Solid Waste Management Board before giving out contracts for this research. If a suitable device is already available, or if more spending won't help, then the funds should be used differently as per another law (Section 43014).

The fees deposited in the Air Pollution Control Fund pursuant to Section 41853.5 are hereby continuously appropriated to the state board for research and development of a cotton gin trash incinerator heat exchanger or other device for the disposal of solid waste which is produced from the ginning of cotton, consistent with emission standards set by a district board or the state board. The state board shall consult with the Solid Waste Management Board prior to awarding a contract for, or conducting, such research and development. If the state board determines that such a device is available or that further expenditures for such purposes would not contribute meaningfully to their development, the fees shall be utilized in accordance with the provisions of Section 43014.
