Section § 69202

Explanation

Every year, the Judicial Council needs to suggest a budget to the Governor and Legislature for improving and constructing appellate court buildings. These projects must adhere to specific state construction laws, and once the Department of Finance gives the go-ahead, the Administrative Office of the Courts will manage the execution of these projects.

(a)CA Government Code § 69202(a) The Judicial Council shall annually recommend to the Governor and the Legislature the amount proposed to be spent for the planning, renovation, and building of facilities for the appellate courts.
(b)CA Government Code § 69202(b) Facilities shall be subject to the State Building Construction Act of 1955 (commencing with Section 15800) and the Property Acquisition Law (commencing with Section 15850), except, notwithstanding any other provision of law, the Administrative Office of the Courts shall serve as the implementing agency upon the approval of the Department of Finance.

Section § 69204

Explanation

This law grants the Judicial Council full control and policymaking authority over California's appellate court facilities. This includes acquiring and developing properties, planning and constructing buildings, and managing operations and maintenance. The Council is responsible for creating policies to ensure these facilities meet court needs and can allocate state funds for their upkeep and construction. They prepare funding requests and manage the design and construction processes of any new projects, coordinating with the Department of Finance for budget proposals. In addition, they manage long-term planning, set construction priorities, and ensure appellate court funding remains separate from trial court funds.

The Judicial Council, as the policymaking body for the judicial branch, shall have the following responsibilities and authorities with regard to appellate court facilities, in addition to any other authority or responsibilities established by law:
(a)CA Government Code § 69204(a) Exercise full responsibility, jurisdiction, control, and authority as an owner would have over appellate court facilities, including, but not limited to, the acquisition and development of facilities.
(b)CA Government Code § 69204(b) Exercise the full range of policymaking authority over appellate court facilities, including, but not limited to, planning, construction, acquisition, and operation, to the extent not otherwise limited by the law.
(c)CA Government Code § 69204(c) Establish policies, procedures, and guidelines for ensuring that the appellate courts have adequate and sufficient facilities, including, but not limited to, facilities’ planning, acquisition, construction, design, operation, and maintenance.
(d)CA Government Code § 69204(d) Allocate appropriated funds for appellate court facilities maintenance and construction, subject to the other provisions of this chapter.
(e)CA Government Code § 69204(e) Prepare funding requests for appellate court facility construction, repair, and maintenance.
(f)CA Government Code § 69204(f) Implement the design, bid, award, and construction of all appellate court construction projects, except as delegated to others.
(g)CA Government Code § 69204(g) Provide for capital outlay projects that may be built with funds appropriated or otherwise available for these purposes, as follows:
(1)CA Government Code § 69204(g)(1) Approve five year and master plans for each appellate court.
(2)CA Government Code § 69204(g)(2) Establish priorities for construction.
(3)CA Government Code § 69204(g)(3) Submit the cost of projects proposed to be funded to the Department of Finance for inclusion in the Governor’s budget.
(h)CA Government Code § 69204(h) Keep funding for appellate court facilities, whether for operation, planning, or construction, separate from funding for trial court facilities.

Section § 69206

Explanation

This law outlines the responsibilities of the Administrative Office of the Courts regarding appellate court facilities. They must implement the policies of the Judicial Council, develop master plans for these facilities, and oversee construction projects, including selecting architects and contractors, unless limited by other laws.

The Administrative Office of the Courts shall have the following responsibilities and authority in addition to other responsibilities and authority granted by law or delegated by the Judicial Council:
(a)CA Government Code § 69206(a) Carry out the policies of the Judicial Council in regard to appellate court facilities, except as otherwise limited by the law.
(b)CA Government Code § 69206(b) Develop for Judicial Council approval the master plans for appellate court facilities in each court.
(c)CA Government Code § 69206(c) Construct appellate court buildings, including, but not limited to, selection of architects and contractors, except as otherwise limited by the law.
