Section § 67810

Explanation

This section defines key terms for understanding and applying California laws related to reusing military bases. It describes what various terms mean in this context, such as 'authority' for a military base reuse authority, 'basewide facility' and 'local facility' referring to public capital facilities, and 'board' as the governing body of the authority.

It also defines the 'authority reuse plan' as a plan for future base use, 'public capital facilities' including infrastructure like roads and schools critical for the base's reuse, and the 'redevelopment authority' for handling the federal transfer of base property.

Unless the context otherwise requires, the definitions contained in this chapter govern the construction of this title.

Section § 67811

Explanation

Counties and cities in California can create a special organization, known as an authority, which will have specific powers and responsibilities. To do this, they must pass resolutions following the guidelines in another section of the law, Section 67820.

Counties and cities may establish an authority with the powers and duties set forth in this title upon the adoption of resolutions pursuant to Section 67820.

Section § 67812

Explanation

This law establishes that a certain public corporation is independent from the agencies that appointed its board. It has specific powers and responsibilities defined by this title, unrelated to any other laws. The law emphasizes that managing the reuse of military bases is crucial to the entire state. Therefore, the authority's powers and duties are prioritized over any local governments, like cities or counties, and any joint powers authorities.

The authority is a public corporation of the State of California that is independent of the agencies from which its board is appointed. Notwithstanding any other provision of law, the powers and duties of the authority are those granted or imposed by this title. The Legislature finds and declares that the planning, financing, and management of the reuse of military bases is a matter of statewide importance, and that the powers and duties granted to the authority by this title shall prevail over those of any local entity, including any city or county, whether formed under the general laws of the State of California or pursuant to a charter, and any joint powers authority.

Section § 67813

Explanation

This section describes the role of the authority in overseeing the conversion of a military base into civilian use, including planning, financing, and managing the transition process.

The purpose of the authority is to plan for, finance, and manage the transition of the military base from military to civilian use.
