Explanation

This law allows the board overseeing a specific authority to receive contributions from public agencies that have a representative on the board. These agencies must contribute a certain amount determined by the board for each board member they appoint, and the payment is due by August of each fiscal year. Importantly, the term 'public agency' in this context does not refer to any elected officials of the federal or state government.

In addition to any funds received from federal and state agencies for the expenses of operating the authority, the board may receive contributions from agencies represented on the board. Each agency represented by a board member shall contribute to the authority, on or before August of each fiscal year, a sum to be determined by the board for each board member that the agency appoints. For purposes of this section, the term “public agency” does not include any elected official of the federal or state government.

Explanation

This law allows a board and its member agencies to make agreements to transfer money from sales tax, property tax, or other sources. These funds are used to pay for services or build facilities that benefit military base developments. Contracts can specify that funds are given to agencies responsible for services or facilities at the base, and outline repayment terms, such as paying back with interest or through shared revenue from future development at the base. All contracts require approval from the board and involved agencies.

The board and the member agencies may provide by contract for the transfer to the board or between member agencies of revenues available from sales tax, property tax, or other sources in order to help finance the cost of paying for services or capital facilities to serve or enhance the development of military bases. The contract or contracts may provide for the transfer of funds to member agencies with responsibility for providing services or facilities within the area of military bases for a specified number of years, and for the repayment of those funds in later years with interest, or for repayment in the form of an equity interest in property, sales, or other tax revenues that may be payable as a result of development occurring within the area of the military base. Any such contract shall be effective only upon approval by the board and the member agencies involved.
