Section § 85600

Explanation

This law requires the Secretary of State to indicate in the state ballot pamphlet which candidates running for statewide offices have voluntarily agreed to stick to specific spending limits. For State Senate and Assembly candidates, local election officers must show this information in the voter information section of the sample ballot if they have also agreed to the same spending limits.

The Secretary of State shall designate in the state ballot pamphlet those candidates for statewide elective office, as defined in Section 82053, who have voluntarily agreed to the expenditure limitations set forth in Section 85400. Local elections officers shall designate in the voter information portion of the sample ballot those candidates for State Senate and Assembly who have voluntarily agreed to the expenditure limitations set forth in Section 85400.

Section § 85601

Explanation

If you're running for a statewide office in California and agree to limit your campaign spending, you can pay to include a 250-word statement in the state's voter pamphlet. Just remember, you can't mention your opponents in this statement. You have to follow the Secretary of State's rules and deadlines for the submission.

However, if you don't agree to the spending cap, your statement won’t be included after November 6, 2002. The same rules apply if you're a candidate for State Senate or Assembly; you can pay for a similar statement in the sample ballot's voter information section, sticking to the same word limit and not mentioning opponents.

(a)CA Government Code § 85601(a) A candidate for statewide elective office, as defined in Section 82053, who accepts the voluntary expenditure limits set forth in Section 85400 may purchase the space to place a statement in the state ballot pamphlet that does not exceed 250 words. The statement may not make any reference to any opponent of the candidate. The statement shall be submitted in accordance with timeframes and procedures set forth by the Secretary of State for the preparation of the state ballot pamphlets.
(b)CA Government Code § 85601(b) Notwithstanding subdivision (e) of Section 88001 of this code or subdivision (e) of Section 9084 of the Elections Code, on and after November 6, 2002, the Secretary of State may not include in the state ballot pamphlet a statement from a candidate who has not voluntarily agreed to the expenditure limitations set forth in Section 85400.
(c)CA Government Code § 85601(c) A candidate for State Senate or Assembly who accepts the voluntary expenditure limits set forth in Section 85400 may purchase the space to place a statement in the voter information portion of the sample ballot that does not exceed 250 words. The statement may not make any reference to any opponent of the candidate.
