Section § 93000

Explanation

This law section establishes the official name of the title as the Great Redwood Trail Agency Act. It became effective on March 1, 2022.

(a)CA Government Code § 93000(a) This title shall be known and may be cited as the Great Redwood Trail Agency Act.
(b)CA Government Code § 93000(b) This section shall become operative on March 1, 2022.

Section § 93004

Explanation

This section defines key terms for understanding the law concerning the Great Redwood Trail. "Agency" refers to the Great Redwood Trail Agency, and the "dividing line" is the county line between Mendocino and Sonoma Counties. The law became effective on March 1, 2022.

(a)CA Government Code § 93004(a) For purposes of this title, the following definitions apply:
(1)CA Government Code § 93004(a)(1) “Agency” means the Great Redwood Trail Agency.
(2)CA Government Code § 93004(a)(2) “Dividing line” means the county line separating the Counties of Mendocino and Sonoma at or near mile post 89.
(b)CA Government Code § 93004(b) This section shall become operative on March 1, 2022.

Section § 93005

Explanation

This law designates the agency as a local agency under the Disaster Assistance Act, which means it is eligible to receive support for disaster-related projects and needs. This provision took effect on March 1, 2022.

(a)CA Government Code § 93005(a) The agency is a local agency for purposes of the Disaster Assistance Act (Chapter 7.5 (commencing with Section 8680) of Division 1 of Title 2).
(b)CA Government Code § 93005(b) This section shall become operative on March 1, 2022.

Section § 93006

Explanation

This law states that no state funds can be used to start or run rail services on certain rail lines north of Willits, nor to upgrade or maintain existing facilities, except for trail design, construction, or railbanking purposes. It also prohibits the use of state money, including bond funds, for new bulk coal terminal projects in Humboldt County. A "new bulk coal terminal" is defined as having potential significant environmental impacts due to coal storage, handling, or transport.

(a)CA Government Code § 93006(a) State moneys shall not be used to initiate or operate rail service on the North Coast Railroad Authority’s, the Great Redwood Trail Agency’s, or any successor in interest’s rail rights-of-way north of the City of Willits or for a project that is designed to rehabilitate, modernize, maintain, or repair an existing operation or facility, including a rail terminal, a railyard, a rail facility, and rail infrastructure, except for trail design or construction or to satisfy railbanking requirements, on the North Coast Railroad Authority’s, the Great Redwood Trail Agency’s, or any successor in interest’s rail rights-of-way north of the City of Willits.
(b)CA Government Code § 93006(b) State moneys, including proceeds from the sale of general obligation bonds, shall not be spent for any new bulk coal terminal projects within the County of Humboldt.
(c)CA Government Code § 93006(c) For purposes of this section, “new bulk coal terminal” means a terminal that stores, handles, or transports coal in bulk to a degree or significance that is categorized as having the potential for significant impacts in an environmental document prepared pursuant to the California Environmental Quality Act (Division 13 (commencing with Section 21000) of the Public Resources Code) as a result of the storage, handling, or transportation of coal in bulk.
