Section § 93010

Explanation

This law establishes that the North Coast Railroad Authority, which serves Humboldt, Marin, Mendocino, Sonoma, and Trinity counties, will be renamed the Great Redwood Trail Agency starting March 1, 2022. Any legal references to the North Coast Railroad Authority now refer to the new name, Great Redwood Trail Agency. Existing materials like forms and logos won't be discarded; they'll be used until they're no longer usable or run out.

(a)CA Government Code § 93010(a) The North Coast Railroad Authority is hereby created, having a service area comprising the Counties of Humboldt, Marin, Mendocino, Sonoma, and Trinity.
(b)CA Government Code § 93010(b) On March 1, 2022, the North Coast Railroad Authority shall be renamed the Great Redwood Trail Agency.
(c)CA Government Code § 93010(c) Whenever the term “North Coast Railroad Authority” appears in a law, the term means the “Great Redwood Trail Agency.”
(d)CA Government Code § 93010(d) Existing supplies, forms, insignias, signs, logos, uniforms, emblems, and other materials shall not be destroyed or changed as a result of renaming the North Coast Railroad Authority as the Great Redwood Trail Agency, and those materials shall continue to be used until exhausted or unserviceable.

Section § 93011

Explanation

This law outlines how the board of directors for a certain agency is structured and governed. The board will consist of two appointees each from the county boards of Humboldt, Marin, Mendocino, and Sonoma, as well as a representative chosen by the cities that are served by the rail line. The Governor can also appoint two nonvoting directors from the Transportation and Natural Resources Agencies. All voting directors serve two-year terms.

Interestingly, the law allows someone to serve on this board even if they hold another government position, which is usually not allowed under common law. This new rule took effect on March 1, 2022.

(a)CA Government Code § 93011(a) The agency shall be governed by a board of directors, composed as follows:
(1)CA Government Code § 93011(a)(1) Two persons appointed by each of the boards of supervisors of the Counties of Humboldt, Marin, Mendocino, and Sonoma.
(2)CA Government Code § 93011(a)(2) A city representative, selected by the cities served by the rail line.
(3)CA Government Code § 93011(a)(3) The Governor may appoint a nonvoting director from the Transportation Agency and a nonvoting director from the Natural Resources Agency.
(b)CA Government Code § 93011(b) All directors, except the nonvoting directors, shall serve for terms of two years and until their successors have qualified.
(c)Copy CA Government Code § 93011(c)
(1)Copy CA Government Code § 93011(c)(1) Notwithstanding any other law, including the common law doctrine that precludes the simultaneous holding of incompatible offices, a local government officer or a member of a state commission may be appointed and may serve as a member of the agency’s board of directors if the person also meets the other applicable qualifications of this title.
(2)CA Government Code § 93011(c)(2) Notwithstanding any other law, including the common law doctrine that precludes the simultaneous holding of incompatible offices, a member of the agency’s board of directors may also serve as a local government officer or a member of a state commission.
(d)CA Government Code § 93011(d) This section shall become operative on March 1, 2022.
