Section § 23730

Explanation

This law states that every special election related to a city's charter, whether it’s electing a charter commission or dealing with charter-related changes or repeals, must be organized by the local government. They must pass an ordinance that sets the election date, specifies its purpose, establishes voting districts, designates polling places, and names the election officers for each district.

Every special election held under the provisions of this chapter, for the election of a charter commission or for the submission of a proposed or revised charter, or any amendment or amendments thereto, or repeal thereof, shall be called by the governing body, by ordinance, which shall specify the purpose and time of such election and shall establish the election precincts and designate the polling places therein, and the names of the election officers for each such precinct.

Section § 23731

Explanation

This law requires that the county elections official sends a sample ballot to each eligible registered voter in the county. The process for holding, conducting, and canvassing the election results will follow the same procedures as general elections.

The county elections official shall prepare and mail to each eligible registered voter in the county a sample ballot. In all other respects, the election shall be held and conducted, the returns canvassed and the result declared by the governing body in the same manner as provided by law for general elections.

Section § 23732

Explanation

When voters need to elect a group to draft or change a local government charter, or to vote on proposed charter changes or repeals during a general election, standard election laws for county officials and public voting on proposals should be followed if they fit the situation.

Whenever a charter commission shall be elected, or any such proposed charter or revised charter, or amendment or amendments thereto, or repeal thereof, shall be submitted, at a general election, the general laws applicable to the election of county officers and the submission of propositions to the vote of electors, shall be followed insofar as the same may be applicable.
