Section § 40401
This law allows a city's legislative body to use the city's annual income to fund various public works projects. These projects can include building and repairing bridges, purchasing and improving land for parks and playgrounds, and maintaining streets and sidewalks. The city can also remove obstructions, establish street grades, and manage public highways and tunnels. Additionally, they can construct sidewalks, plant shade trees, and handle general maintenance of these areas.
Section § 40403
This law allows a city's legislative body to decide if it's necessary to build a bridge connecting the city to a nearby road area. If they decide the bridge needs to take over or damage private property, whether inside or outside the city, they can pass a resolution to make it official. Then, they can follow legal procedures to go ahead with the necessary actions.
Section § 40404
This law allows a city's legislative body to take private property if it's necessary for public projects. This can include making or improving streets, creating pathways for utilities like sewers and water, changing stream paths, developing waterfronts, or maintaining public harbors. They can also acquire property for any other legally permitted purpose.
