Section § 1651

Explanation

This law explains who is responsible for paying the costs of bonds, which are like insurance policies, for certain government officers and their staff. If state officers need these bonds, the state covers the cost. County officers have their bond premiums paid by their county. Similarly, judicial district officers' bond charges are paid by the county where the district is located. For school district officers, their respective school districts pay. Lastly, city officers' bond premiums are paid by the city.

The premium or charge for bonds given by surety companies for the officers, herein named, and for their deputies, clerks, assistants or subordinate officers shall be paid as follows:
(a)CA Government Code § 1651(a) State officers, by the State.
(b)CA Government Code § 1651(b) County officers, by the county.
(c)CA Government Code § 1651(c) Officers of a judicial district, by the county in which the district is situated.
(d)CA Government Code § 1651(d) School districts or other special district officers, by the school district or other special district, respectively.
(e)CA Government Code § 1651(e) City officers, by the city.

Section § 1652

Explanation

This law states that when the state, county, city, or district pays for a bond, the cost (premium or charge) cannot be more than 0.5% per year of the bond's amount. However, the least they could pay is $25 per year.

No premium or charge paid by the state, a county, city, or district shall exceed one-half of 1 percent per annum on the amount of the bond, but a minimum premium or charge of twenty-five dollars ($25) per annum may be imposed.

Section § 1653

Explanation

This law states that a county is not responsible for paying the insurance premiums on bonds for deputies, clerks, assistants, or other subordinate officers unless the county's board of supervisors has approved the bond amount.

The payment of premiums for all bonds of deputies, clerks, assistants or subordinate officers of county officers shall not be a county charge unless the amount fixed for such bond has been approved by the board of supervisors.
