Section § 58130
This law requires that, within 20 days of setting the boundaries for a new district, the authority in charge must organize and announce an election. This election will decide if the district will be established and who will be elected as its officers, if applicable.
Section § 58131
This law section explains how elections are organized for certain districts, detailing two main exceptions from general district elections:
(a) The supervising authority is responsible for setting up election precincts, choosing polling places, announcing the election, and appointing the election board.
(b) The supervising authority also receives, reviews, and officially announces the election results in their next regular meeting after the election.
Section § 58132
If more than half of the votes in an election support forming a district, the supervising authority must officially declare the district established. They will assign a name to the district and outline its boundaries in their records.
Section § 58133
As soon as a district's formation is officially declared, the clerk needs to file a certified copy of that declaration with the Secretary of State and also record it in every county where the district's land is located. Once these steps are done, the district is officially established.
