Section § 67100

Explanation

This law section requires the agency to create and implement rules and policies that support regional and temporary plans. These rules should cover a wide range of topics including zoning, tree removal, waste management, shoreline development, and environmental protections such as air pollution control and watershed protection.

The agency shall adopt all necessary ordinances, rules, regulations and policies to effectuate the adopted regional and interim plans. The regulations shall contain general, regional standards including but not limited to the following: subdivision; zoning; tree removal; solid waste disposal; sewage disposal; land fills, excavations, cuts and grading; piers; harbors, breakwaters; or channels and other shoreline developments; waste disposal in shoreline areas; waste disposal from boats; mobilehome parks; house relocation; outdoor advertising; flood plain protection; soil and sedimentation control; air pollution; and watershed protection.

Section § 67100.1

Explanation

This law states that if an agency, under certain rules or policies, needs to review or approve a proposal, whether it's public or private, they must make a final decision within 60 days of receiving it. They can either approve, ask for changes, or reject the proposal.

Whenever, under the provisions of this title, or any ordinance, rule or regulation or policy adopted pursuant thereto, the agency is required to review or approve any proposal, public or private, the agency shall take final action, either to approve, to require modification, or to reject such proposal within 60 days after such proposal is delivered to the agency.

Section § 67101

Explanation

This section requires that interim rules be established within 90 days, and final rules be completed within 18 months, after a new agency is formed.

Interim regulations shall be adopted within 90 days from the formation of the agency and final regulations within 18 months after the formation of the agency.

Section § 67102

Explanation

This law requires that any rules or policies set by an agency must be enforced not only by the agency itself but also by local governments, including counties and cities.

All ordinances, rules, regulations and policies adopted by the agency shall be enforced by the agency, and by the counties and cities.

Section § 67103

Explanation

Before starting construction, all public works projects must be checked and approved by a relevant agency to ensure they follow the regional general plan.

All public works projects shall be reviewed prior to construction and approved by the agency as to the project’s compliance with the adopted regional general plan.

Section § 67103.1

Explanation

If you want to submit a public works project to the Tahoe Regional Planning Agency, you first need to get it approved by the agency responsible for reviewing and approving it.

All public works projects submitted to the agency for review and approval must receive the agency’s approval before they can be submitted to the Tahoe Regional Planning Agency.

Section § 67104

Explanation
Before applying for state or federal funding for public works projects, these projects must first get approval from the relevant agency to ensure they align with the regional plan.
All public works projects for which state or federal funds are requested shall be approved by the agency as to the project’s compliance with the adopted regional plan prior to submission of application to the state or federal agency.

Section § 67105

Explanation

This law states that a specific agency is responsible for making sure that the laws and guidelines in a certain area are being followed. If a local government is not enforcing these rules, the agency can take them to court to ensure they do.

The agency shall police the region to ensure compliance with the general plan and adopted ordinances, rules, regulations and policies. If it is found that the general plan, or ordinances, rules, regulations and policies are not being enforced by a local jurisdiction, the agency may bring action in a court of competent jurisdiction to ensure compliance.

Section § 67106

Explanation

If someone breaks a rule set by the agency, it is considered a minor crime, known as a misdemeanor.

Violation of any ordinance of the agency is a misdemeanor.

Section § 67107

Explanation

This law allows a government agency to start and be part of contracts and agreements with local authorities in the area or with other government bodies, as long as these are allowed by state or federal law.

The agency is hereby empowered to initiate, negotiate and participate in contracts and agreements among the local governmental authorities of the region, or any other intergovernmental contracts or agreements authorized by state or federal law.

Section § 67108

Explanation

This law states that when governments work together through contracts or agreements, they must arrange their own funding and staffing. However, it allows these cooperative efforts to receive additional financial support from local authorities or other sources.

Each intergovernmental contract or agreement shall provide for its own funding and staffing, but this shall not preclude financial contributions from the local authorities concerned or from supplementary sources.

Section § 67109

Explanation

When a new city is created in the area, the governing body's membership will increase by adding a member from the new city's legislative group. Additionally, the Governor will appoint another member to represent the public, who must not live in the region.

Whenever a new city is formed within the region, the membership of the governing body shall be increased by one additional member appointed by, and who shall be a member of, the legislative body of the new city.
Whenever the membership of the governing body is increased by the addition of a member representing a new city in the region, there shall be appointed by the Governor an additional member representing the public at large who shall not be a resident of the region.
