Section § 95029

Explanation

The law mandates that by October 1, 1996, an independent evaluation must be conducted on a specific program related to developmental services. This evaluation has to cover several important areas: how efficient and cost-effective the administration and mandated program components are at both state and local levels; how well services from regional centers and local educational agencies meet the goals of a federal law for individuals with disabilities; whether services for infants and families have improved and if families are more satisfied; how effective family resource centers are; and if the current funding models for Part C are adequate. The evaluation will be paid for with federal funds.

The State Department of Developmental Services and the State Department of Education shall ensure that an independent evaluation of the program and its structure is completed by October 1, 1996. The evaluation shall address the following issues:
(a)CA Government Code § 95029(a) The efficiency and cost-effectiveness of the state administrative structure, the local interagency coordinating structure, and the mandatory program components.
(b)CA Government Code § 95029(b) The degree to which programs and services provided through regional centers and local educational agencies fulfill the purpose of Part C of the federal Individuals with Disabilities Education Act.
(c)CA Government Code § 95029(c) The extent to which implementation of the program has resulted in improved services for infants and their families, and greater satisfaction with service delivery by families.
(d)CA Government Code § 95029(d) The outcomes and effectiveness of family resource centers.
(e)CA Government Code § 95029(e) The adequacy of the Part C funding models. The evaluation shall be funded with federal funds.

Section § 95029.5

Explanation

The State Department of Education in California is required to conduct a study on how special instruction and services are provided to infants and toddlers who are deaf or hard of hearing. This study should explore the personnel and approaches used for both single and multiple disabilities, assess resource adequacy, and examine the costs of ensuring qualified teachers provide services. The results and recommendations for improving these services must be reported to the Legislature by January 1, 2006.

(a)CA Government Code § 95029.5(a) The State Department of Education shall conduct a study of the current methods of providing special instruction and other services to infants and toddlers who are deaf or hard of hearing. The study shall be funded, upon appropriation by the Legislature, by any available federal funds administered by the State Department of Education and shall include, but not be limited to, all of the following:
(1)CA Government Code § 95029.5(a)(1) The personnel utilized.
(2)CA Government Code § 95029.5(a)(2) The varying approaches utilized in providing services to individuals with single disabilities, as compared to the approaches used in providing services to individuals with multiple disabilities, including hearing impairments.
(3)CA Government Code § 95029.5(a)(3) The adequacy of the resources and personnel standards.
(4)CA Government Code § 95029.5(a)(4) The costs associated with ensuring that infants and toddlers who are deaf or hard of hearing received special instruction from credentialed teachers of the deaf.
(b)CA Government Code § 95029.5(b) The department shall report to the Legislature by January 1, 2006, recommendations regarding how to best provide and fund appropriate quality services for these children.
