The private corporations eligible must have been organized after September 15, 1935, specifically for creating foreign-trade zones. These zones are set up following federal regulations outlined by Congress.

(a)CA Government Code § 6302(a) A public corporation may apply for the privilege of establishing, operating, and maintaining a foreign-trade zone in accordance with the act of Congress.
(b)CA Government Code § 6302(b) Any private corporation organized under the laws of the state subsequent to September 15, 1935, for the purpose of establishing, operating, and maintaining a foreign-trade zone in accordance with the act of Congress may apply for the privilege of establishing, operating, and maintaining a foreign-trade zone in accordance with the act of Congress.

Section § 6304

Explanation

This law allows certain public or private corporations in California to set up and run foreign-trade zones if they meet specific requirements. The corporations must follow rules and conditions outlined in a federal law and any changes made to it in the future. They also need to adhere to guidelines set by a designated board responsible for overseeing these zones.

Any public or private corporation authorized by this chapter to apply and whose application is granted pursuant to the terms of the act of Congress may establish, operate, and maintain the foreign-trade zone:
(a)CA Government Code § 6304(a) Subject to the conditions and restrictions of the act of Congress, and any amendments thereto.
(b)CA Government Code § 6304(b) Under such rules and regulations and for the period of time that may be prescribed by the board established by the act of Congress to carry out the act.
