Explanation

This law states that when you buy livestock, unless there's a specific guarantee given, you shouldn't assume the animals are guaranteed to meet specific standards or purposes.

In the absence of an express warranty, the mere sale of livestock shall not be construed to imply a warranty of such livestock for any particular purpose.

Section § 18502

Explanation

When you buy livestock for slaughter in California, even if there's no written guarantee, the sale does not automatically include a promise that the animals are suited for a specific use or that they meet a standard quality. This is true regardless of other general rules about product guarantees.

In the absence of any express warranty, the sale of livestock for slaughter, whether the slaughter will be immediate or otherwise, shall not imply a warranty of fitness for any particular purpose or warranty of merchantable quality, notwithstanding the provisions of subdivisions (1), (2), and (5) of Section 1735 of the Civil Code.
