Section § 7120

Explanation

In California, it's illegal to have more than the daily limit of fish, amphibians, or reptiles if you've caught them with a fishing license, unless special rules say otherwise.

It is unlawful for any person to possess more than one daily bag limit of any fish, amphibian, or reptile taken under a license issued pursuant to Article 3 (commencing with Section 7145) unless authorized by regulations adopted by the commission.

Section § 7121

Explanation

In California, it's generally illegal to sell or buy fish or amphibians that are either caught in California's waters or brought into the state. Additionally, any fish or amphibians caught on boats that take sports fishermen cannot be bought, sold, or held in a business dealing with fish, unless they are specifically being canned or smoked according to particular rules set by the commission.

Except as otherwise provided by this code or by regulation, it is unlawful to sell or purchase any fish or amphibia taken in, or brought into, the waters of the state, or brought ashore at any point in the state.
It is unlawful to buy, sell, or possess in any place of business where fish are bought, sold, or processed, any fish or amphibia taken on any boat, barge, or vessel which carries sport fishermen, except those fish may be possessed in such a place only for the purposes of canning or smoking under regulations adopted by the commission.

Section § 7123

Explanation

This law requires the California Department of Fish and Wildlife to create a program where observers can voluntarily join vessels to watch marlin fishing by sportfishermen. The department is also responsible for getting insurance to protect the boat owners or operators if an observer gets injured or dies while performing their job.

The department shall develop a voluntary participation program for the use of departmental observers on board vessels to monitor the taking of marlin by sportfishermen. The department shall, in accordance with Section 1012, procure insurance against the liability of the owners or operators of vessels boarded by observers in the event of injury to or death of any such observer in the course and scope of employment as an observer.
