Section § 1740

Explanation

This law is officially called the Black Bass Conservation and Management Act of 1980, and it focuses on the preservation and management of black bass fish populations.

This chapter shall be known as the Black Bass Conservation and Management Act of 1980.

Section § 1741

Explanation

This law states that California aims to protect and improve black bass (a type of fish) populations. The goal is to ensure people have enjoyable fishing experiences involving black bass.

The Legislature hereby finds and declares that it is the policy of the state to preserve and enhance black bass resources and to manage black bass populations to provide satisfactory recreational opportunities to the public.

Section § 1742

Explanation

This law clarifies that the black bass management program is a part of the existing warmwater fisheries program of the department, meaning it will be funded using the current budget for that department.

The Legislature further finds and declares that the black bass management program components specified in this chapter are a continuation of the department’s existing warmwater fisheries program, and, as such, shall be funded from existing department budgetary resources.

Section § 1743

Explanation

This law sets out how California's Department of Fish and Wildlife should manage black bass fish. First, the department must monitor and regulate how many black bass are caught, recommending changes if overfishing is a problem. They should also consider rules for catch-and-release, including size limits, to protect big fish in certain areas. The department will look at different types of black bass when making these policies. Additionally, they’ll work on improving and supporting habitat along shorelines where the fish live. For this section, "black bass" refers to fish from the Centrarchidae family.

(a)CA Fish and Game Code § 1743(a) The department’s black bass management program shall include, but not be limited to, the following components:
(1)CA Fish and Game Code § 1743(a)(1) The department shall determine the angler harvest of black bass populations and shall recommend to the commission the changes in angling regulations for black bass that would be necessary to prevent or correct overharvest.
(2)CA Fish and Game Code § 1743(a)(2) The department shall consider recommending to the commission catch and release regulations for black bass, including minimum or maximum size restrictions and management for trophy-sized black bass in some waters.
(3)CA Fish and Game Code § 1743(a)(3) The department shall consider the suitability of the many different species, subspecies, and strains of black bass when management programs are formulated.
(4)CA Fish and Game Code § 1743(a)(4) The department shall improve shoreline habitat for black bass in waters where insufficient habitat exists and shall encourage reservoir operating agencies to carry out shoreline habitat improvement projects.
(b)CA Fish and Game Code § 1743(b) For the purposes of this section, “black bass” means fishes of the Centrarchidae family.
