Section § 15300

Explanation

This law explains where you can legally get aquatic plants and animals to use as brood stock, which is essentially breeding stock. You can obtain them from commercial fishing license holders, registered aquaculturists, the department, or through approved imports.

Aquatic plants or animals may be legally obtained for use as brood stock from all of the following sources:
(a)CA Fish and Game Code § 15300(a) A holder of a commercial fishing license.
(b)CA Fish and Game Code § 15300(b) A registered aquaculturist.
(c)CA Fish and Game Code § 15300(c) The department.
(d)CA Fish and Game Code § 15300(d) Imported sources authorized by Chapter 7 (commencing with Section 15600).

Section § 15301

Explanation

This law allows the California Department of Fish and Game to sell wild aquatic plants and animals for aquaculture use. However, this doesn't include rare, endangered, or fully protected species. The price of these plants and animals will be based on the administrative costs, and the exact price will be determined by the commission.

Aquaculturists need written approval from the department to collect these plants and animals. The department can regulate when, where, and how the collection is done and may charge a fee for processing the approval.

Additionally, there's a specific fee of $500 for collecting sturgeon or striped bass broodstock, which is an exception to the general pricing rule.

(a)CA Fish and Game Code § 15301(a) The department may sell wild aquatic plants or animals, except rare, endangered, or fully protected species, for aquaculture use at a price approximating the administrative cost to the department for the collection or sale of the plants or animals. The commission shall set this price.
(b)CA Fish and Game Code § 15301(b) Aquatic plants and animals may be collected by a registered aquaculturist only with the written approval of the department. The department may specify the time, place, and manner of collection and may collect a fee from the aquaculturist in an amount sufficient to cover the cost of processing the approval.
(c)CA Fish and Game Code § 15301(c) Notwithstanding subdivision (a), the fee for collecting sturgeon or striped bass broodstock shall be five hundred dollars ($500).
