Section § 399

Explanation

This law states that if necessary, the commission can quickly change rules related to wildlife protection or public welfare. They can take such action after holding at least one hearing. Specifically, they can do this if it's urgent to protect animals or their habitats, or if it's needed to ensure public safety and welfare.

Notwithstanding any other provision of this code, the commission, when adopting, amending, or repealing a regulation pursuant to authority vested in it by this code, may, after at least one hearing, adopt, amend, or repeal that regulation pursuant to Section 11346.1 of the Government Code, if it makes either of the following findings:
(a)CA Fish and Game Code § 399(a) That the adoption, amendment, or repeal is necessary for the immediate conservation, preservation, or protection of birds, mammals, fish, amphibians, or reptiles, including, but not limited to, their nests or eggs.
(b)CA Fish and Game Code § 399(b) That the adoption, amendment, or repeal is necessary for the immediate preservation of the public peace, health and safety, or general welfare.
