Section § 6700

Explanation

This law states that minors can create contracts just like adults can, but they have the unique ability to cancel or void these contracts under certain circumstances. However, their ability to enter into marriage contracts follows additional rules under a different set of laws.

Except as provided in Section 6701, a minor may make a contract in the same manner as an adult, subject to the power of disaffirmance under Chapter 2 (commencing with Section 6710), and subject to Part 1 (commencing with Section 300) of Division 3 (validity of marriage).

Section § 6701

Explanation

This law states that minors, who are people under 18, cannot do certain legal actions. Specifically, they can't give someone else power to act on their behalf, make contracts about real estate, or make contracts about personal property they don't have with them.

A minor cannot do any of the following:
(a)CA Family Law Code § 6701(a) Give a delegation of power.
(b)CA Family Law Code § 6701(b) Make a contract relating to real property or any interest therein.
(c)CA Family Law Code § 6701(c) Make a contract relating to any personal property not in the immediate possession or control of the minor.
