Section § 6950

Explanation

This law allows a court in California to grant permission for a minor who is 16 years or older to join the U.S. armed forces, even if they don't have a parent or guardian available to consent. The court must decide the minor's situation meets all the necessary conditions. Additionally, there is no charge for this legal process.

(a)CA Family Law Code § 6950(a) Upon application by a minor, the court may summarily grant consent for enlistment by the minor in the armed forces of the United States if the court determines all of the following:
(1)CA Family Law Code § 6950(a)(1) The minor is 16 years of age or older and resides in this state.
(2)CA Family Law Code § 6950(a)(2) The consent of a parent or guardian is necessary to permit the enlistment, and the minor has no parent or guardian available to give the consent.
(b)CA Family Law Code § 6950(b) No fee may be charged for proceedings under this section.
