Section § 14151

Explanation

This California law allows the director to set rules for which pesticide applications must be done by someone with a valid qualified applicator certificate, or under their supervision.

The director may, by regulation, specify the pesticide applications that shall be made by or under the supervision of a person holding a valid qualified applicator certificate.

Section § 14152

Explanation

This law outlines how to apply for and renew a qualified applicator certificate, which is a requirement for certain professional activities. You need to fill out a form provided by the director, include your name, address, and any other requested details, and pay a fee. These certificates expire on December 31 of the last valid year. To renew, you must apply before it expires using the same process and fee structure. If you apply late, there will be a penalty fee.

An application for a qualified applicator certificate shall be in the form prescribed by the director. Each application shall state the name and address of the applicant specified on the application and any other information required by the director. The application shall be accompanied by a fee as prescribed by the director pursuant to Section 11502.5. All certificates issued under this chapter shall expire on December 31 of the last year for which they are issued. Certificates may be renewed before their expiration through application in the form prescribed by the director and upon payment of a fee as prescribed by the director pursuant to Section 11502.5. A penalty shall be assessed against any applicant who applies for renewal after the expiration date as prescribed by the director pursuant to Section 11502.5.

Section § 14153

Section § 14153.1

The director may designate subcategories within the categories established pursuant to Section 14153, as determined to be necessary.

Section § 14154

Explanation

If someone meets all the necessary conditions outlined in this chapter, the director will give them a qualified applicator certificate.

The director shall issue a qualified applicator certificate to each applicant who satisfies the requirements of this chapter.

Section § 14155

Explanation

If you hold a qualified applicator certificate, it can be refused, revoked, or suspended by the director if you break certain rules. The reasons include not following pesticide rules, not properly supervising pesticide use, or creating false records or reports.

A qualified applicator certificate may be refused, revoked, or suspended by the director, after hearing, for any of the following:
(a)CA Food and Agriculture Code § 14155(a) Failure to comply with any applicable provision of this division or Division 6 (commencing with Section 11401) or any regulation adopted pursuant to these divisions.
(b)CA Food and Agriculture Code § 14155(b) Failure to supervise pesticide applications in a manner that ensures compliance with this division and Division 6 (commencing with Section 11401) or any regulation adopted pursuant to these divisions.
(c)CA Food and Agriculture Code § 14155(c) Making any false or fraudulent record or report.
