Section § 550

Explanation

This law states that if you want to prove a particular fact in a legal case, you are responsible for providing the evidence unless the law says otherwise. If no evidence is presented, the decision will go against the person who is supposed to provide the evidence. Initially, the person who must prove something in the case must also show the evidence for it.

(a)CA Evidence Code § 550(a) The burden of producing evidence as to a particular fact is on the party against whom a finding on that fact would be required in the absence of further evidence.
(b)CA Evidence Code § 550(b) The burden of producing evidence as to a particular fact is initially on the party with the burden of proof as to that fact.
