Section § 6001

Explanation

This section states the official name of the law, which is the “Alquist Open Presidential Primary Act.” This means this chapter can be referred to by this title.

This chapter shall be known and may be cited as the “Alquist Open Presidential Primary Act.”

Section § 6001.5

Explanation

This law states that the rules and guidelines in this chapter are specifically relevant to the Democratic Party.

This chapter applies to the Democratic Party.

Section § 6002

Explanation

This section covers how delegates and alternates are chosen for the Democratic Party in California. It applies to those pledged to a specific presidential candidate as well as those who aren't. Most of the rules follow the guidelines of the Democratic National Committee and the Democratic Party of California, including how candidates express their presidential preferences, the timing, and format of required candidacy statements, and how district-based caucuses are organized. Additionally, the rules cover how delegates and alternates are distributed after primary elections and address any diversity goals for the delegation. The California Democratic Party must share these rules online on their website.

(a)CA Elections Code § 6002(a) This chapter applies both to the selection of delegates and alternates pledged to the candidacy of a particular candidate and to the selection of delegates and alternates not expressing a preference for a particular candidate.
(b)CA Elections Code § 6002(b) Except as otherwise specified in this chapter, the elements and practices to select delegates and alternates shall be the same as set forth in the standing rules and bylaws of the Democratic National Committee and the Democratic Party of California, including the following:
(1)CA Elections Code § 6002(b)(1) The form and timeline for any required statement of candidacy for delegate candidates.
(2)CA Elections Code § 6002(b)(2) The identification of the presidential preference of delegate candidates.
(3)CA Elections Code § 6002(b)(3) The schedule for, conduct of, and type of districts used to organize, caucuses for the selection of district delegate and alternate candidates.
(4)CA Elections Code § 6002(b)(4) The selection of delegates and alternates other than those elected based on the results of district caucuses.
(5)CA Elections Code § 6002(b)(5) The allocation of delegates and alternates to presidential preferences based on the results of the primary election.
(6)CA Elections Code § 6002(b)(6) Any other goals relating to the composition of the delegation.
(c)CA Elections Code § 6002(c) The Democratic Party of California shall post any standing rules and bylaws relating to this chapter on its Internet Web site.

Section § 6003

Explanation

This law states that only voters who are registered as Democrats, along with certain other authorized voters as explained in another section, can take part in selecting delegates during primary elections.

Participation in the delegate selection process in primaries shall be restricted to voters whose affidavits of registration declare the Democratic Party as their party affiliation and any other voter authorized under subdivision (c) of Section 13102.
