Section § 10100

Explanation

This law allows county elections officials to hire additional help when checking signatures on nomination papers or petitions for municipal office candidates. The city is responsible for covering these costs.

Whenever the county elections official is required to examine the signatures upon any nomination paper or petition of any candidate for a municipal office, he or she may employ necessary help for the examination. The cost shall be paid by the city.

Section § 10101

Explanation

This law applies to all municipal elections in the state, unless there is a specific rule in the state Constitution or in a local charter that says otherwise.

This part shall apply to all municipal elections, except where otherwise provided for in the Constitution of the state, or in a charter duly adopted or amended pursuant to the Constitution of this state.

Section § 10102

Explanation

This law states that the rules about how candidates can describe themselves on ballots, known as ballot designations, apply to city elections in California. These rules are the same whether the city follows general state laws or has its own charter.

Section 13107, relating to ballot designations, shall apply to municipal elections, whether held in a general law or chartered city.

Section § 10103

Explanation
This law states that the rules about write-in votes, as described in two different parts of the California Elections Code, also apply to city elections in general law cities.
Part 3 (commencing with Section 8600) of Division 8 and Chapter 7 (commencing with Section 15350) of Division 15, relating to write-in votes, shall apply to municipal elections held in general law cities.

Section § 10104

Explanation

If you need to do something election-related by a specific deadline, but the election office is closed on that day because of a local government decision, you can do it on the next business day, and it will still be valid as if done on the original deadline.

This rule doesn't apply if the election is combined with another one as specified in certain legal codes.

(a)CA Elections Code § 10104(a) Notwithstanding Section 15, if the last day for the performance of any act provided for or required by this code is a day when the elections official’s office is closed pursuant to a resolution or ordinance of the legislative body, the act may be performed upon the next business day with the same effect as if it had been performed upon the day appointed.
(b)CA Elections Code § 10104(b) This section is not applicable when the election is consolidated with another election pursuant to Part 3 (commencing with Section 10400) of Division 10.
