Irregularity or improper conduct shall annul or set aside a nomination only if it appears that illegal votes in the precinct have been given to the defendant, which if taken from him or her, would reduce the number of his legal votes below the number of votes given to the contestant.

Section § 16300
This section states that a nomination can be annulled or invalidated if illegal votes were cast in favor of the nominated person. It's only effective if these illegal votes, when removed, lower the nominated person's final vote count to less than what another contender received.
