Section § 32340

Explanation

This law states that any education superintendent or board in California who gives out teaching credentials without following legal procedures is committing a misdemeanor, which is a type of crime.

Any state, county, or city and county superintendent, or any state, county, or city and county board of education, who issues a credential, except as provided by law, is guilty of a misdemeanor.

Section § 32341

Explanation

This law allows county or city and county boards of education to register the certifications or documents of employees who need specific qualifications to work as teachers or in roles requiring certification in schools managed by the county superintendent. However, this only applies if the service isn't already being provided by a school district under a different law, Section 44332.5.

Except where such service is provided by a school district pursuant to Section 44332.5, each county or city and county board of education may provide for the registration of any valid certification or other document authorizing the holder thereof to serve in a position requiring certification qualifications as an employee of the county superintendent of schools of such county or city and county or of a school district under the jurisdiction of such county superintendent of schools.
