Section § 17055

Explanation

This law permits funding for building up to four elementary or junior high schools in urban areas that typically require demolishing existing buildings. These schools should not include grades 10 to 12. The construction must aim to avoid displacing residents or businesses as much as possible. Innovative design options like underground facilities, multiuse buildings, or combining school facilities with shopping centers or parks are encouraged to achieve this.

(a)CA Education Code § 17055(a) The board shall authorize project funding under this chapter for the construction, in urban areas in which the construction of schools would ordinarily require the removal of residential, commercial, or industrial structures, of four elementary or junior high schools, or any combination thereof, none of which serve any of the grades 10 to 12, inclusive.
(b)CA Education Code § 17055(b) The construction funded pursuant to subdivision (a) shall be designed to minimize the need for the relocation of inhabitants of residential, commercial, or industrial structures. The design features of the schools may include, but should not be limited to, the use of below-ground facility construction, multistory construction, multiuse construction where single-use construction currently exists, the joint use of facilities that otherwise involve such uses as a shopping center, office complex, or apartment building, the joint or dual use of land that otherwise involves park or other uses, overhead or underground parking, or the use of areas above or below streets or freeways.

Section § 17056

Explanation

If a school district in California wants funding for a new school project, it can apply based on its eligibility. Once approved, the district’s governing board must first pick an area for the new school. Next, they must set criteria to find the best school design and request design proposals that meet these criteria.

Any school district that is a project applicant under this chapter may apply for the funding of a school specifically under this article, pursuant to which it may be approved by the board for funding only to the extent of its project eligibility under this chapter. The governing board of each district for which that funding is approved by the board shall do all of the following, in the order specified:
(a)CA Education Code § 17056(a) Identify an area within the district that it determines to be appropriate for the construction of a school that meets the purposes of this article.
(b)CA Education Code § 17056(b) Establish criteria for the purpose of identifying the school design that will most effectively accomplish the purposes of this article and the needs of the district. The district shall thereupon issue, in a manner approved by the board, a request for architectural design proposals incorporating those criteria.

Section § 17058

Explanation

This law states that any project funded under this specific program cannot cost more than what is normally permitted for similar projects in the same overall funding chapter.

The cost of any project funded under this article shall not exceed the maximum cost that would otherwise be allowable for a project funded under this chapter.
