Section § 1748.30
This section defines several terms related to debit cards. 'Accepted debit card' refers to a debit card requested, signed, or used by the cardholder or a person authorized by them. An 'account' means a personal or household bank account, like checking or savings. 'Debit card' refers to a tool for accessing funds electronically, even without a PIN. 'Debit card issuer' is the entity that provides the card. A 'debit cardholder' is the person to whom the card is given. 'Unauthorized use' is the use of a debit card without permission or benefit to the cardholder, excluding cases where the cardholder allowed someone to use it and hasn't revoked that permission, or if the card issuer uses it themselves.
Section § 1748.31
This law explains when a debit cardholder is responsible for unauthorized use of their card. Generally, cardholders are only liable up to $50 if specific conditions are met, like being given notice of potential liability and instructions on reporting lost or stolen cards. However, if a cardholder doesn’t report unauthorized use seen on a statement within 60 days, they might have to pay for charges made after that period, unless there are valid reasons for the delay, like illness or travel. Importantly, cardholders aren’t responsible for mistakes or fraud by the card issuer or its employees.
