Explanation

This law defines 'law' as a serious and formal declaration made by the highest authority within the state.

Law is a solemn expression of the will of the supreme power of the State.

Section § 22.1

Explanation

This section explains that the ultimate authority in California is expressed through two main sources: the Constitution and the statutes (which are basically laws passed by the legislature).

The will of the supreme power is expressed:
(a)CA Civil Law Code § 22.1(a) By the Constitution.
(b)CA Civil Law Code § 22.1(b) By statutes.

Section § 22.2

Explanation

This law states that the courts in California should use the common law of England as a guideline for decisions, as long as it doesn't conflict with the U.S. Constitution or the state's own Constitution and laws.

The common law of England, so far as it is not repugnant to or inconsistent with the Constitution of the United States, or the Constitution or laws of this State, is the rule of decision in all the courts of this State.
