Section § 6630

Explanation
This section defines an 'operating rule' as a regulation set by the board that covers how the common interest development is run or how the association conducts its business.
For the purposes of this article, “operating rule” means a regulation adopted by the board that applies generally to the management and operation of the common interest development or the conduct of the business and affairs of the association.

Section § 6632

Explanation

For an operating rule to be valid, it has to meet four main criteria: It must be written down, fall within the board's legal authority, not conflict with existing laws or documents like the declaration or bylaws, and be reasonable, made or changed in good faith.

An operating rule is valid and enforceable only if all of the following requirements are satisfied:
(a)CA Civil Law Code § 6632(a) The rule is in writing.
(b)CA Civil Law Code § 6632(b) The rule is within the authority of the board conferred by law or by the declaration, articles of incorporation or association, or bylaws of the association.
(c)CA Civil Law Code § 6632(c) The rule is not in conflict with governing law and the declaration, articles of incorporation or association, or bylaws of the association.
(d)CA Civil Law Code § 6632(d) The rule is reasonable, and is adopted, amended, or repealed in good faith.
