Section § 6580

Explanation

This section explains when a common interest development is officially created. It happens if someone buys a separate property along with a piece of shared property or membership in an association, as long as certain documents are on record. These documents include a declaration, any existing condominium plan, and a map if required by related government rules.

Subject to Section 6582, this act applies and a common interest development is created whenever a separate interest coupled with an interest in the common area or membership in the association is, or has been, conveyed, provided all of the following are recorded:
(a)CA Civil Law Code § 6580(a) A declaration.
(b)CA Civil Law Code § 6580(b) A condominium plan, if any exists.
(c)CA Civil Law Code § 6580(c) A final map or parcel map, if Division 2 (commencing with Section 66410) of Title 7 of the Government Code requires the recording of either a final map or parcel map for the common interest development.

Section § 6582

Explanation

This law is about commercial or industrial properties that are part of a common interest development, which means they share certain areas. It clarifies that it does not apply to any real estate projects that do not have shared spaces.

(a)CA Civil Law Code § 6582(a) This act applies only to a commercial or industrial common interest development.
(b)CA Civil Law Code § 6582(b) Nothing in this act may be construed to apply to a real property development that does not contain common area. This subdivision is declaratory of existing law.
