Section § 20030

Explanation

When a franchise is being terminated or not renewed, the company must provide written notice to the franchisee. This notice must be sent by a method that provides receipt confirmation, such as registered or certified mail, a telegram, or through personal delivery. The notice must clearly state the company's intent to end or not renew the franchise, why they're doing it, and the exact date this change will take effect.

All notices of termination or nonrenewal required by this chapter:
(a)CA Business & Professions Code § 20030(a) Shall be in writing;
(b)CA Business & Professions Code § 20030(b) Shall be posted by registered, certified or other receipted mail, delivered by telegram or personally delivered to the franchisee; and
(c)CA Business & Professions Code § 20030(c) Shall contain a statement of intent to terminate or not renew the franchise:
(1)CA Business & Professions Code § 20030(c)(1) Together with the reasons therefor, and
(2)CA Business & Professions Code § 20030(c)(2) The effective date of such termination or nonrenewal or expiration.
