Section § 6590

Explanation
All the fees that the bureau collects go into a special fund called the Professional Fiduciary Fund. This money can only be used by the bureau for specific purposes if the Legislature decides to allocate it.
All fees collected by the bureau shall be paid into the Professional Fiduciary Fund in the State Treasury, which is hereby created. The money in the fund shall be available to the bureau for expenditure for the purposes of this chapter only upon appropriation by the Legislature.

Section § 6591

Explanation

This law section states that the Professional Fiduciary Fund is now the official fund that replaces those previously managed under the Statewide Registry by the Department of Justice according to the Probate Code.

The Professional Fiduciary Fund shall be the successor fund to those funds deposited under the Statewide Registry with the Department of Justice pursuant to Chapter 13 (commencing with Section 2850) of Part 4 of Division 4 of the Probate Code.

Section § 6592

This section explains that the bureau is responsible for setting various fees related to professional fiduciary licenses. These include fees for taking or retaking the licensing exam, obtaining a new license, renewing a license, and changing a license status to 'retired', 'inactive', or 'active'. (a)CA Business & Professions Code § 6592(a) The fee for a professional fiduciary examination and reexamination shall be set by the bureau through regulation at the amount necessary to recover the actual costs to develop and administer the examination.
(b)CA Business & Professions Code § 6592(b) The license fee to obtain a professional fiduciary license shall be set by the bureau.
(c)CA Business & Professions Code § 6592(c) The renewal fee for a professional fiduciary license shall be set by the bureau.
(d)CA Business & Professions Code § 6592(d) The bureau shall set the fee to designate a license status of “retired.”
(e)CA Business & Professions Code § 6592(e) The fee to designate a license status of “inactive” shall be set by the bureau.
(f)CA Business & Professions Code § 6592(f) The bureau shall set the fee to reinstate a license to “active” from a status of “retired” or “inactive.”
(g)CA Business & Professions Code § 6592(g) The bureau shall set the fees pursuant to subdivisions (b), (c), (d), (e), and (f) by regulation at an amount necessary to recover the reasonable costs to the bureau in carrying out those functions pursuant to this chapter.
