Section § 5680

Explanation

This law explains that licenses must be renewed every 24 months, with the expiration date determined by the board to spread out renewals throughout the year. To renew a license, the holder needs to apply and pay the required fee before it expires. The renewal form must include a statement about any recent criminal convictions or disciplinary actions by other agencies, ensuring all information is true and correct, to the best of the licensee's knowledge.

(a)CA Business & Professions Code § 5680(a) Licenses issued under this chapter shall expire no more than 24 months after the issue date. The expiration date of the original license shall be set by the board in a manner to best distribute renewal procedures throughout each year.
(b)CA Business & Professions Code § 5680(b) To renew an unexpired license, the licenseholder shall, on or before the expiration date of the license, apply for renewal on a form prescribed by the board, and pay the renewal fee prescribed by this chapter.
(c)CA Business & Professions Code § 5680(c) The renewal form shall include a statement specifying whether the licensee was convicted of a crime or disciplined by another public agency during the preceding renewal period and that the licensee’s representations on the renewal form are true, correct, and contain no material omissions of fact, to the best knowledge and belief of the licensee.

Section § 5680.05

Explanation

If a licensed professional is found guilty by a California court of a crime or responsible for causing harm through fraud, negligence, or other unprofessional behavior, the court clerk must inform the relevant licensing board within 10 days.

Within 10 days after a judgment by a court of this state that a licenseholder has committed a crime or is liable for any death, personal or property injury or loss caused by the licenseholder’s fraud, deceit, negligence, incompetency, or recklessness in practice, the clerk of the court which rendered the judgment shall report this to the board.

Section § 5680.1

Explanation

This California law says that you can renew a professional license that has expired within five years, by applying with the right form and paying all past due fees. If you renew more than 30 days after expiration, you also have to pay a late fee. The renewal takes effect when you file the application, pay the fees, or pay the late fee, whichever happens last. Your renewed license will then stay valid until the next expiration date set by another related rule.

Except as otherwise provided in this chapter, a license that has expired may be renewed at any time within five years after its expiration on filing of an application for renewal on a form prescribed by the board, and payment of all accrued and unpaid renewal fees. If the license is renewed more than 30 days after its expiration, the licenseholder, as a condition precedent to renewal, shall also pay the delinquency fee prescribed by this chapter. Renewal under this section shall be effective on the date on which the application is filed, on the date on which all renewal fees are paid, or on the date on which the delinquency fee, if any, is paid, whichever last occurs. If so renewed, the license shall continue in effect through the date provided in Section 5680 that next occurs after the effective date of the renewal, when it shall expire if it is not again renewed.

Section § 5680.2

Explanation
If your professional license expires and you don't renew it within five years, you can't simply renew it. Instead, you'll need to apply for a new license and meet all the original requirements, including paying the necessary fees.
A license that is not renewed within five years after its expiration may not be renewed, restored, reissued, or reinstated thereafter, but the holder of the expired license may apply for and obtain a new license if they pay all of the fees and meet all of the requirements set forth in this chapter for obtaining an original license.

Section § 5681

Explanation

This section outlines the fees charged by the board for landscape architect applicants and licensees. These fees cover various processes including application review, exams, original and duplicate licenses, renewals, and penalties for not updating addresses or paying on time. For instance, there's a $100 application fee to check eligibility for exams, while the fee for taking the California Supplemental Exam is $350, which may increase to $400 through regulation. An original license costs $700, with adjustments if issued close to expiration. Renewal fees are also $700 but can be increased to $800. There are penalties up to $50 for late address changes and specific fees for delinquent renewals or school application approvals.

The fees prescribed by this chapter for landscape architect applicants and landscape architect licensees shall be fixed by the board as follows:
(a)CA Business & Professions Code § 5681(a) The application fee for reviewing an applicant’s eligibility to take any section of the examination shall be one hundred dollars ($100).
(b)CA Business & Professions Code § 5681(b) The fee for any section of the examination administered by the board shall not exceed the actual cost to the board for purchasing and administering each exam. The fee for the California Supplemental Examination shall be three hundred fifty dollars ($350). The board may adopt regulations to set the fee at a higher amount, up to a maximum of four hundred dollars ($400).
(c)CA Business & Professions Code § 5681(c) The fee for an original license shall be seven hundred dollars ($700) and the board may adopt regulations to set the fee at a higher amount, up to a maximum of eight hundred dollars ($800), except that, if the license is issued less than one year before the date on which it will expire, then the fee shall equal 50 percent of the fee fixed by the board for an original license. The board may, by appropriate regulation, provide for the waiver or refund of the initial license fee where the license is issued less than 45 days before the date on which it will expire.
(d)CA Business & Professions Code § 5681(d) The fee for a duplicate license shall be three hundred dollars ($300).
(e)CA Business & Professions Code § 5681(e) The renewal fee shall be seven hundred dollars ($700). The board may adopt regulations to set the fee at a higher amount, up to a maximum of eight hundred dollars ($800).
(f)CA Business & Professions Code § 5681(f) The penalty for failure to notify the board of a change of address within 30 days from an actual change in address may not exceed fifty dollars ($50).
(g)CA Business & Professions Code § 5681(g) The delinquency fee shall be 50 percent of the renewal fee for the license in effect on the date of the renewal of the license, but not less than fifty dollars ($50) nor more than two hundred dollars ($200).
(h)CA Business & Professions Code § 5681(h) The fee for filing an application for approval of a school pursuant to Section 5650 may not exceed six hundred dollars ($600) charged and collected on an biennial basis.

Section § 5682

Explanation

This law requires that all fees collected by the department each month must be deposited within 10 days into the California Architects Board-Landscape Architects Fund in the State Treasury.

Within 10 days after the beginning of every month, all fees collected by the department for the month preceding, under the provisions of this chapter, shall be paid into the State Treasury to the credit of the California Architects Board-Landscape Architects Fund, which is hereby created.

Section § 5683

Explanation

This law section states that the money collected and placed in the California Architects Board-Landscape Architects Fund is designated for use to cover the expenses of the board. Additionally, it is used to implement and enforce the rules and regulations set in this chapter.

The money paid into the California Architects Board-Landscape Architects Fund shall be used for expenditure in the manner prescribed by law to defray the expenses of the board and in carrying out and enforcing the provisions of this chapter.
