Section § 7599.70

This law details the fees and penalties involved in obtaining and renewing various licenses and certificates related to alarm company operations. The bureau shall establish and assess fees and penalties for licensure and registration as follows:
(a)CA Business & Professions Code § 7599.70(a) An alarm company operator license application fee shall be at least three hundred seventy dollars ($370) and may be increased to an amount not to exceed four hundred seven dollars ($407).
(b)CA Business & Professions Code § 7599.70(b) An original license fee for an alarm company operator license shall be at least six hundred dollars ($600) and may be increased to an amount not to exceed six hundred sixty dollars ($660). A renewal fee for an alarm company operator license shall be seven hundred fifty dollars ($750) and may be increased to an amount not to exceed eight hundred twenty-five dollars ($825).
(c)CA Business & Professions Code § 7599.70(c) A qualified manager certificate application and examination fee shall be at least three hundred fifty dollars ($350) and may be increased to an amount not to exceed three hundred eighty-five dollars ($385).
(d)CA Business & Professions Code § 7599.70(d) A renewal fee for a qualified manager certificate shall be at least two hundred twenty-five dollars ($225) and may be increased to an amount not to exceed two hundred forty-eight dollars ($248).
(e)CA Business & Professions Code § 7599.70(e) An original license fee for a branch office certificate shall be at least two hundred fifty dollars ($250) and may be increased to an amount not to exceed two hundred seventy-five dollars ($275). A renewal fee for a branch office certificate shall be at least one hundred fifty dollars ($150) and may be increased to an amount not to exceed one hundred sixty-five dollars ($165).
(f)CA Business & Professions Code § 7599.70(f) Notwithstanding Section 163.5, the reinstatement fee as required by Sections 7593.12 and 7598.17 is the amount equal to the renewal fee plus a penalty of 50 percent thereof.
(g)CA Business & Professions Code § 7599.70(g) A fee for reexamination of an applicant for a qualified manager shall be at least sixty dollars ($60) and may be increased to an amount not to exceed sixty-six dollars ($66).
(h)CA Business & Professions Code § 7599.70(h) An initial registration fee for an alarm agent shall be at least fifty-five dollars ($55) and may be increased to an amount not to exceed sixty dollars ($60).
(i)CA Business & Professions Code § 7599.70(i) A registration renewal fee for an alarm agent shall be at least forty dollars ($40) and may be increased to an amount not to exceed forty-four dollars ($44).
(j)CA Business & Professions Code § 7599.70(j) A firearms permit fee shall be at least one hundred dollars ($100) and may be increased to an amount not to exceed one hundred ten dollars ($110), and a firearms permit renewal fee shall be at least eighty dollars ($80) and may be increased to an amount not to exceed eighty-eight dollars ($88).
(k)CA Business & Professions Code § 7599.70(k) The fingerprint processing fee is that amount charged the bureau by the Department of Justice.
(l)CA Business & Professions Code § 7599.70(l) The processing fee required pursuant to Section 7598.14 is the amount equal to the expenses incurred to provide a photo identification card.
(m)CA Business & Professions Code § 7599.70(m) The fee for a Certificate of Licensure, as specified in Section 7593.8, shall be twenty-five dollars ($25).
(n)CA Business & Professions Code § 7599.70(n) The delinquency fee is 50 percent of the renewal fee in effect on the date of expiration, but not less than twenty-five dollars ($25).
(o)CA Business & Professions Code § 7599.70(o) The processing fee for the assignment of an alarm company operator license pursuant to Section 7593.15 shall be at least four hundred dollars ($400) and may be increased to an amount not to exceed four hundred forty dollars ($440).
(p)CA Business & Professions Code § 7599.70(p) The fee for the replacement of a lost or destroyed registration card, license, certificate, or permit authorized by this chapter shall be twenty-five dollars ($25). The request for a replacement of a registration card, license, certificate, or permit shall be made in the manner prescribed by the bureau.
(q)CA Business & Professions Code § 7599.70(q) The fee for an endorsed verification of licensure, certification, registration, or permit shall be twenty-five dollars ($25). The verification document shall include the license, certificate, registration, or permit number, the license, certificate, registration, or permit history and current status, the date of the endorsement, an embossed seal, and the signature of the chief.
(r)CA Business & Professions Code § 7599.70(r) The reinstatement fee following a suspension pursuant to subdivision (f) of Section 7599.34 and Section 7599.62 shall be 25 percent of the renewal fee.

Section § 7599.71

Explanation
The director provides one free copy of licensing laws, rules, regulations, manuals, or guides to any applicant or licensee. For additional copies, there's a fee covering production costs and sales tax. Money collected is used to produce these materials, while sales tax is sent to the State Board of Equalization.
The director shall furnish one copy of any issue or edition of the licensing law, rules and regulations, manuals, or guides to any applicant or licensee without charge. The director shall charge and collect a fee equivalent to the cost of producing such laws, rules and regulations, manuals, or guides, plus sales tax for each additional copy which may be furnished on request to any applicant or licensee, and for each copy furnished on request to any other person. All moneys derived, pursuant to this section except for any sales tax collected shall be used to cover the costs of producing copies of such laws, rules and regulations, manuals or guides. All moneys collected for sales tax shall be remitted to the State Board of Equalization.

Section § 7599.72

Explanation

This law requires the department to keep track of all money earned from activities related to this chapter. Every month, it must report the amount collected to the Controller and then hand it over to the Treasurer, who will deposit it into the Private Security Services Fund.

The department shall receive and account for all money derived from the operation of this chapter and, at the end of each month, shall report that money to the Controller and shall pay it to the Treasurer, who shall keep the money in the Private Security Services Fund.

Section § 7599.73

Explanation

If you apply for or already have a license, you usually can't get your fees back unless there's a specific rule that allows it, as detailed in another law section.

Application or licensee fees shall not be refunded except in accordance with Section 158.

Section § 7599.74

Explanation

The money collected under Section 7591.9 must be used to fund the enforcement activities of the bureau.

All money derived from Section 7591.9 shall be used to support the bureau’s enforcement program.

Section § 7599.75

Explanation

This law requires that money earned and spent for licensing and overseeing alarm company operators and alarm agents be tracked in separate financial statements. Any funds collected from their licenses must only go towards regulating them. If there's extra money at the end of the year—enough to cover the next two years' regulatory costs—fees need to be lowered in the following year so that there's no excess.

There shall be a separate budget and expenditure statement and a separate revenue statement outlining all moneys derived from and expended for the licensing and regulation of alarm company operators and alarm agents in accordance with the provisions of this chapter.
All moneys derived from the licensing of alarm company operators and alarm agents shall be expended exclusively on the regulation of alarm company operators and alarm agents.
If at the end of any fiscal year, the moneys derived from the licensing of alarm company operators and alarm agents is in surplus in an amount which equals or is more than the moneys necessary for the regulation of alarm company operators and alarm agents for the next two fiscal years, license or other fees shall be reduced, during the following fiscal year in an amount which will reduce any surplus moneys derived from the licensing of alarm company operators and alarm agents to an amount less than the moneys expended for the regulation of alarm company operators and alarm agents for the next two fiscal years.
This section shall become operative on and after July 1, 1983.
