Section § 2920

Explanation

The Board of Psychology has the responsibility to oversee and enforce the chapter it's governed by. The board includes nine members, four of whom are from the public. This section of the law is only valid until January 1, 2026, after which it will be removed and the board will be subject to government committee review.

(a)CA Business & Professions Code § 2920(a) The Board of Psychology shall enforce and administer this chapter. The board shall consist of nine members, four of whom shall be public members.
(b)CA Business & Professions Code § 2920(b) This section shall remain in effect only until January 1, 2026, and as of that date is repealed.
(c)CA Business & Professions Code § 2920(c) Notwithstanding any other law, the repeal of this section renders the board subject to review by the appropriate policy committees of the Legislature.

Section § 2920.1

Explanation

This law section emphasizes that the Board of Psychology in California must prioritize public safety above all else when it comes to licensing, regulating, and disciplining psychologists. If there's ever a conflict between public protection and other goals, the public's safety must come first.

Protection of the public shall be the highest priority for the Board of Psychology in exercising its licensing, regulatory, and disciplinary functions. Whenever the protection of the public is inconsistent with other interests sought to be promoted, the protection of the public shall be paramount.

Section § 2921

Explanation

This section specifies that each board member is appointed for a four-year term and can remain in the role until a new member is appointed or one year after their term technically ends, whichever comes first. Board members are limited to serving two back-to-back terms.

Each member of the board shall hold office for a term of four years, and shall serve until the appointment and qualification of his or her successor or until one year shall have elapsed since the expiration of the term for which he or she was appointed, whichever first occurs. No member may serve for more than two consecutive terms.

Section § 2922

Explanation

This law outlines how the members of a specific board for psychologists are chosen in California. The Governor is responsible for selecting members who should represent different psychologist interests across the state. The Governor also appoints two public members and five licensed psychologist members. Additionally, the Senate Rules Committee and the Speaker of the Assembly each appoint a public member when vacancies occur.

In appointing the members of the board, except the public members, the Governor shall use his or her judgment to select psychologists who represent, as widely as possible, the varied professional interests of psychologists in California.
The Governor shall appoint two of the public members and the five licensed members of the board qualified as provided in Section 2923. The Senate Rules Committee and the Speaker of the Assembly shall each appoint a public member, and their initial appointment shall be made to fill, respectively, the first and second public member vacancies which occur on or after January 1, 1983.

Section § 2923

Explanation

To be on this board, all members must live in California. Most should be licensed psychologists, but public members can't be licensed under this board or related chiropractic or osteopathic boards.

Each member of the board shall have all of the following qualifications:
(a)CA Business & Professions Code § 2923(a) He or she shall be a resident of this state.
(b)CA Business & Professions Code § 2923(b) Each member appointed, except the public members shall be a licensed psychologist.
The public members shall not be licentiates of the board or of any board under this division or of any board referred to in the Chiropractic Act or the Osteopathic Act.

Section § 2924

Explanation

This law allows the Governor to dismiss any member of a specific board if they fail to do their job, are not competent, or behave unprofessionally.

The Governor has power to remove from office any member of the board for neglect of any duty required by this chapter, for incompetency, or for unprofessional conduct.

Section § 2925

Explanation
Every year, the board chooses a president and a vice president from its members.
The board shall elect annually a president and vice president from among its members.

Section § 2926

Explanation

The board is required to have at least one meeting every year, but more meetings can be scheduled if the chairman calls for them or if any two board members request them in writing.

The board shall hold at least one regular meeting each year. Additional meetings may be held upon call of the chairman or at the written request of any two members of the board.

Section § 2927

Explanation

This law means that to make official decisions, at least five board members must be present at a meeting.

Five members of the board shall at all times constitute a quorum.

Section § 2927.5

Explanation

Every regular meeting of the board must be announced according to the rules set out in the Bagley-Keene Open Meeting Act. This law ensures that the public is properly informed about when these meetings are happening, promoting transparency and accountability.

Notice of each regular meeting of the board shall be given in accordance with the Bagley-Keene Open Meeting Act (Article 9 (commencing with Section 11120) of Chapter 1 of Part 1 of Division 3 of Title 2 of the Government Code).

Section § 2928

Explanation
This law specifies that the board is responsible for managing and enforcing the rules and regulations within this chapter.
The board shall administer and enforce this chapter.

Section § 2929

Explanation

This law section says that the board is required to create an official seal that they will use on every license they issue.

The board shall adopt a seal, which shall be affixed to all licenses issued by the board.

Section § 2930

Explanation

This section requires the board to create rules and regulations to support this chapter. When doing so, they must follow certain procedures outlined in another part of the law.

The board shall from time to time adopt rules and regulations as may be necessary to effectuate this chapter. In adopting rules and regulations the board shall comply with Chapter 3.5 (commencing with Section 11340) of Part 1 of Division 3 of Title 2 of the Government Code.

Section § 2931

Explanation

This law states that the board is responsible for reviewing and approving whether applicants meet the necessary qualifications to get a license under the rules in this chapter.

The board shall examine and pass upon the qualifications of the applicants for a license as provided by this chapter.

Section § 2933

Explanation

This section explains that the Board of Psychology in California can hire all necessary staff to do their job, using the funds they have. They can also hire an executive officer who doesn't have to follow the usual state hiring rules. The board can spend money and accept donations if it helps them achieve their goals. However, this rule is only in effect until January 1, 2026, after which it will be repealed.

(a)CA Business & Professions Code § 2933(a) Except as provided by Section 159.5, the board shall employ and shall make available to the board within the limits of the funds received by the board all personnel necessary to carry out this chapter. The board may employ, exempt from the State Civil Service Act, an executive officer to the Board of Psychology. The board shall make all expenditures to carry out this chapter. The board may accept contributions to effectuate the purposes of this chapter.
(b)CA Business & Professions Code § 2933(b) This section shall remain in effect only until January 1, 2026, and as of that date is repealed.

Section § 2934

Explanation

This law allows the board to publish an updated directory of licensed psychologists every two years. The directory can be provided to psychologists and others who are interested, with the receivers paying the cost of production.

Notwithstanding Section 112, the board may issue, biennially, a current geographical directory of licensed psychologists. The directory may be sent to licensees and to other interested parties at cost.

Section § 2934.1

Explanation

This law allows a board to share information online about the status of licenses for both current and former licensees. They can post if a licensee has been involved in any disciplinary actions or enforcement cases like temporary restraining orders, suspensions, or citations. The law also allows them to post historical info like where a licensee got their degree and includes a potential link to their professional site. The board may decide what other information to post based on regulations.

(a)CA Business & Professions Code § 2934.1(a) The board may post on its Internet Web site the following information on the current status of the license for all current and former licensees:
(1)CA Business & Professions Code § 2934.1(a)(1) Whether or not the licensee has a record of a disciplinary action.
(2)CA Business & Professions Code § 2934.1(a)(2) Any of the following enforcement actions or proceedings against the licensee:
(A)CA Business & Professions Code § 2934.1(a)(2)(A) Temporary restraining orders.
(B)CA Business & Professions Code § 2934.1(a)(2)(B) Interim suspension orders.
(C)CA Business & Professions Code § 2934.1(a)(2)(C) Revocations, suspensions, probations, or limitations on practice ordered by the board or by a court with jurisdiction in the state, including those made part of a probationary order, cease practice order, or stipulated agreement.
(D)CA Business & Professions Code § 2934.1(a)(2)(D) Accusations filed by the board, including those accusations that are on appeal, excluding ones that have been dismissed or withdrawn where the action is no longer pending.
(E)CA Business & Professions Code § 2934.1(a)(2)(E) Citations issued by the board. Unless withdrawn, citations shall be posted for five years from the date of issuance.
(b)CA Business & Professions Code § 2934.1(b) The board may also post on its Internet Web site all of the following historical information in its possession, custody, or control regarding all current and former licensees:
(1)CA Business & Professions Code § 2934.1(b)(1) Institutions that awarded the qualifying educational degree and type of degree awarded.
(2)CA Business & Professions Code § 2934.1(b)(2) A link to the licensee’s professional Internet Web site. Any link that provides access to a licensee’s professional Internet Web site, once clicked, shall be accompanied by a notification that informs the Internet Web site viewer that they are no longer on the board’s Internet Web site.
(c)CA Business & Professions Code § 2934.1(c) The board may also post other information designated by the board in regulation.

Section § 2935

Explanation

The members of the board are entitled to receive a daily allowance and reimbursement for expenses, as detailed in another section of the law.

Each member of the board shall receive a per diem and expenses as provided in Section 103.

Section § 2936

Explanation

This law requires the psychology board to create programs for educating both consumers and professionals about ethical practices in psychology. The board must use the APA's Ethical Principles and Code of Conduct as the standard for ethical behavior. All licensed psychologists must display a notice in their office with contact information for the Board of Psychology, allowing consumers to ask questions or report complaints.

The board shall adopt a program of consumer and professional education in matters relevant to the ethical practice of psychology. The board shall establish as its standards of ethical conduct relating to the practice of psychology, the “Ethical Principles of Psychologists and Code of Conduct” published by the American Psychological Association (APA). Those standards shall be applied by the board as the accepted standard of care in all licensing examination development and in all board enforcement policies and disciplinary case evaluations.
To facilitate consumers in receiving appropriate psychological services, all licensees and registrants shall be required to post, in a conspicuous location in their principal psychological business office, a notice which reads as follows:

If you have questions or complaints, you may contact the board by email at bopmail@dca.ca.gov, on the Internet at www.psychology.ca.gov, by calling 1-866-503-3221, or by writing to the following address:
