Section § 4240

Explanation

This law explains that the California Hazardous Substances Act is relevant to pharmacies and pharmacists. The board responsible for these entities can enforce the act to protect public health, especially if it relates to pharmacy practices, but must first provide regulatory notice. It also mentions that 'poison' refers to certain hazardous substances, and the board can further clarify what substances are considered poisons by creating specific regulations.

(a)CA Business & Professions Code § 4240(a) The California Hazardous Substances Act, Chapter 4 (commencing with Section 108100) of Part 3 of Division 104 of the Health and Safety Code, applies to pharmacies and pharmacists and any other person or place subject to the jurisdiction of the board.
(b)CA Business & Professions Code § 4240(b) The board may enforce that act when necessary for the protection of the health and safety of the public if prior regulatory notice is given in accordance with the rulemaking provisions of the Administrative Procedure Act (Chapter 3.5 (commencing with Section 11340) of Part 1 of Division 3 of Title 2 of the Government Code). Board enforcement shall focus on those hazardous substances that relate significantly to or overlap the practice of pharmacy.
(c)CA Business & Professions Code § 4240(c) “Poison” as used in this chapter refers to a category of hazardous substances defined in Section 108125 of the Health and Safety Code. The board may by regulation make the category more specific.
