Section § 5499.30

Explanation

This law requires that any advertisement offering legal help for workers' compensation must name at least one lawyer involved with the advertising entity. This includes ads that refer clients to attorneys. Violating this rule is a misdemeanor and can result in jail time, a fine up to $10,000, or both.

(a)CA Business and Professions Code § 5499.30(a) Any individual, firm, corporation, partnership, organization, or association which prints, displays, publishes, distributes, or broadcasts or causes or permits to be advertised, printed, displayed, published, distributed, or broadcast any advertising which purports to provide legal services for obtaining workers’ compensation benefits shall include the name of at least one attorney associated with the individual, firm, corporation, partnership, organization, or association in all such advertising.
(b)CA Business and Professions Code § 5499.30(b) As used in this section, the term “legal services” includes any service which refers potential clients to any attorney.
(c)CA Business and Professions Code § 5499.30(c) A violation of this section is a misdemeanor, punishable by imprisonment in the county jail for not more than one year, or by a fine not exceeding ten thousand dollars ($10,000), or both.
