Section § 7354

Explanation

This law defines a 'mobile unit' as a vehicle that is fully enclosed and equipped to support activities for which the board grants licenses, such as certain professional practices. These mobile units must adhere to health and safety standards set by the board.

For purposes of this article, “mobile unit” means any self-contained, self-supporting, enclosed mobile unit which is licensed as a mobile unit for the practice of any occupation licensed by the board and which complies with this article and all health and safety regulations established by the board.

Section § 7355

Explanation

If you want to run a mobile business unit in California, you need to apply for a license from the board. You can't have broken any laws that would prevent you from getting a license. Your application should include a floor plan of the mobile unit, proof that you own or lease it, the application fee, a valid California driver's license for whoever will drive it, and a home base address. Once your plan and application are okay, you'll need to have the mobile unit approved by the board in person.

(a)CA Business & Professions Code § 7355(a) Any person, firm, or corporation desiring to operate a mobile unit shall make an application to the board for a license containing the information and data set forth in subdivision (b). The applicant, if an individual, or each officer, director, and partner, if the applicant is other than an individual, shall not have committed acts or crimes which are grounds for denial of licensure pursuant to Section 480.
(b)CA Business & Professions Code § 7355(b) Each application shall include the following:
(1)CA Business & Professions Code § 7355(b)(1) A detailed floor plan showing the layout and dimensions of the mobile unit and all necessary systems and equipment contained therein.
(2)CA Business & Professions Code § 7355(b)(2) Proof of purchase or lease of the mobile unit.
(3)CA Business & Professions Code § 7355(b)(3) The required fee.
(4)CA Business & Professions Code § 7355(b)(4) Proof of a valid California driver’s license issued to an officer or employee responsible for driving the mobile unit.
(5)CA Business & Professions Code § 7355(b)(5) A permanent base address from which the mobile unit shall operate.
(c)CA Business & Professions Code § 7355(c) After initial approval of the floor plan and application has been granted, the applicant shall schedule an appointment to show the mobile unit to the board, or representative of the board, for final approval.

Section § 7356

Explanation

If you buy or lease a mobile unit that already has a license, you need to apply with the board to transfer the ownership or control within 10 days. Here's what you need to include in your application: a detailed floor plan, proof of purchase or lease, the current mobile unit license, the required fees, and a valid California driver's license for whoever will drive the unit.

An application to transfer ownership or control of an existing licensed mobile unit shall be filed by the purchaser or lessor with the board within 10 days after purchase. Each application shall include the following:
(a)CA Business & Professions Code § 7356(a) A detailed floor plan showing the layout and dimensions of the mobile unit and all necessary systems and equipment contained therein.
(b)CA Business & Professions Code § 7356(b) Bills of sale or lease documents proving purchase or lease of existing equipment and the mobile unit.
(c)CA Business & Professions Code § 7356(c) The existing mobile unit license.
(d)CA Business & Professions Code § 7356(d) The required fee.
(e)CA Business & Professions Code § 7356(e) Proof of a valid California driver’s license issued to an officer or employee responsible for driving the mobile unit.

Section § 7357

Explanation

This law section is about mobile units used for services like beauty and grooming. It requires these units to be clean and well-maintained. They must also have specific functioning systems: a separate water supply if offering shampoo services, a water heater with at least a six-gallon capacity, and an adequate ventilation system.

(a)CA Business & Professions Code § 7357(a) Mobile units shall comply with regulations adopted by the board that assure that the unit shall be kept clean, in good repair, and in compliance with this article.
(b)CA Business & Professions Code § 7357(b) Each mobile unit shall be equipped with each of the following functioning systems:
(1)CA Business & Professions Code § 7357(b)(1) A self-contained, potable water supply if shampooing services are offered.
(2)CA Business & Professions Code § 7357(b)(2) Continuous, on-demand hot water tanks which shall be not less than six-gallon capacity.
(3)CA Business & Professions Code § 7357(b)(3) A system of adequate ventilation.

Section § 7358

Explanation

This law requires that a mobile unit, like a traveling salon or barber shop, must always be overseen by someone who holds a professional license in this field, except if the person is an apprentice.

A mobile unit shall at all times be in the charge of a person licensed pursuant to this chapter except an apprentice.

Section § 7359

Explanation

This law makes it illegal for anyone to let someone work in a mobile unit doing jobs covered by this chapter unless the person has a proper license from the board. Breaking this rule is considered a misdemeanor, which is a type of criminal offense.

It is unlawful for any person, firm or corporation to hire, employ, allow to be employed, or permit to work, in or about a mobile unit, any person who performs or practices any occupation regulated under this chapter who is not duly licensed by the board.
Any person violating this section is guilty of a misdemeanor.

Section § 7360

Explanation

This law states that if you own or work in a mobile unit where certain regulated professions are performed, you cannot allow any part of it to be used for living, or anything else that might make it dirty or unsafe for customers. But, if the mobile unit is being used outside its licensed area and not for the regulated professions, this rule does not apply.

No person having charge of a mobile unit, whether as an owner or an employee, shall permit any room, or part thereof, in which any occupation regulated under this chapter is conducted or practiced, to be used for residential purposes or for any other purpose that would tend to make the unit unsanitary, unhealthy, or unsafe, or endanger the health and safety of the consuming public.
This section shall not apply when the mobile unit is used for purposes other than the practice of any occupation regulated under this chapter outside of the designated geographical boundaries for which it is licensed.

Section § 7361

Explanation

This law says that the rules that apply to certain businesses or establishments also apply to mobile units, unless there's a specific rule that says otherwise. However, the rules starting with Section 7346 are an exception to this.

All laws governing establishments under this chapter, except Article 6 (commencing with Section 7346), apply to mobile units, unless otherwise provided.
