Section § 7337

Explanation

If you want to apply for an exam and get licensed, you need to fill out a form provided by the board and pay a fee. You also have to prove you meet the qualifications, verify your application under oath, and acknowledge understanding your rights as a licensee based on the board's informational materials about basic labor laws. When you arrive for the exam, you must show a valid photo ID, like a driver's license or government ID. For renewing your license online, you need to confirm you've read and understood the same labor law rights. These rules were updated on July 1, 2017.

(a)CA Business & Professions Code § 7337(a) Every application for admission to examination and licensure shall be in writing, on forms prepared and furnished by the board.
(b)CA Business & Professions Code § 7337(b) Each application shall be accompanied by the required fee, and shall contain proof of the qualifications of the applicant for examination and licensure. It shall be verified by the oath of the applicant and shall include a signed acknowledgment that the applicant understands his or her rights as a licensee as outlined in informational materials on basic labor laws, as specified in Section 7314.3, that the applicant is provided by the board with the application. Every applicant shall, as a condition of admittance to the examination facility, present satisfactory proof of identification. Satisfactory proof of identification shall be in the form of a valid, unexpired driver’s license or identification card, containing the photograph of the person to whom it was issued, issued by any state, federal, or other government entity.
(c)CA Business & Professions Code § 7337(c) Every electronic application to renew a license shall include a signed acknowledgment that the renewal applicant understands his or her rights as a licensee as outlined in informational materials on basic labor laws, as specified in Section 7314.3, that the renewal applicant is provided by the board with the renewal application.
(d)CA Business & Professions Code § 7337(d) The amendments made to this section by the act adding this subdivision shall become operative on July 1, 2017.

Section § 7338

Explanation

This section explains that to get a professional license, applicants must pass a written test that assesses their ability to protect consumers' health and safety. The test will cover the applicant's knowledge and skills related to their specific occupation, including topics like antisepsis, disinfection, and using tools and electricity. Additionally, it will evaluate the applicant's ability to provide services to individuals with different hair types and textures, relevant to their field of practice.

(a)CA Business & Professions Code § 7338(a) The examination of applicants for a license shall consist of a written examination that evaluates competency in protecting the health and safety of consumers of the services provided by licensees.
(b)CA Business & Professions Code § 7338(b) The examination shall include written tests to determine the applicant’s skill in, and knowledge of, the practice of the occupation for which a license is sought and shall include written tests in antisepsis, disinfection, and the use of mechanical apparatus and electricity as applicable to the practice for which the applicant has applied for licensure.
(c)CA Business & Professions Code § 7338(c) The written tests, as specified in subdivision (b), shall determine the applicant’s skill in, and knowledge of, providing services to individuals with varying hair types and textures, as applicable to the practice for which the applicant has applied for licensure.

Section § 7340

Explanation

This law states that all exams will be created by the board or under their guidance. The board is also responsible for setting the rules on how these exams are given and graded, and they must oversee everything to make sure the rules are followed.

All examinations shall be prepared by or under the direction of the board. The board shall establish standards and procedures governing administration and grading and shall exercise supervision as may be necessary to assure compliance therewith.

Section § 7341

Explanation

If someone doesn't pass an exam from the board mentioned in this chapter, they will be informed of their total score.

The board shall deliver to every person failing any examination provided for in this chapter the total grade received on the examination.

Section § 7342

Explanation

If you want to get a license for a specific job, you need to pass an exam, meet certain legal qualifications, and pay a fee. If you do all this, the board will give you a license on the day you pass the exam. This license allows you to work in that job at a licensed place.

Licenses in the practice of the occupation for which the license was sought shall be issued by the board to any applicant who satisfactorily passes an examination, who possesses the other qualifications required by law and who has remitted the license fee required by this chapter. The license shall entitle the holder to engage in the practice of that occupation in a licensed establishment. The license shall be issued by the board on the same day that the applicant satisfactorily passes the examination.

Section § 7344

Explanation

This section allows the board to set up or rent the necessary spaces and facilities to hold examinations.

The board may contract or otherwise arrange for reasonably required physical accommodations and facilities to conduct examinations.

Section § 7345

Explanation

If you apply for something and don't finish the process within a year, or if you don’t take the exam within a year after you’re eligible, your application is considered abandoned, and you lose the fee you paid. If you want to apply again after this happens, you’ll need to start over as if you’re applying for the first time.

If an applicant fails to complete his or her application within one year after it has been filed, or fails to take the examination within one year after becoming eligible therefor, the application shall be considered abandoned and the fee forfeited. An application submitted after the abandonment of a former application shall be treated as a new application and shall be required to meet all of the requirements for an initial license.
