Section § 2535

Explanation

This law states that all professional licenses issued by this board expire at midnight on the last day of the licensee's birth month in the second year of their two-year term unless they renew it. License holders need to fill out a form from the board and pay a renewal fee to keep their license active.

(a)CA Business and Professions Code § 2535(a) All licenses issued as of January 1, 1992, shall expire at 12 a.m. of the last date of the birth month of the licensee during the second year of a two-year term if not renewed.
(b)CA Business and Professions Code § 2535(b) All licenses issued under this chapter, except those licenses issued pursuant to subdivision (a), shall expire at 12 a.m. of the last date of the birth month of the licensee during the second year of a two-year term, if not renewed.
(c)CA Business and Professions Code § 2535(c) To renew an unexpired license, the licensee shall, on or before the date of expiration of the license, apply for renewal on a form provided by the board, accompanied by the prescribed renewal fee.

Section § 2535.2

Explanation

This statute says that if your license has expired, you can renew it anytime within five years by submitting a renewal application and paying any outstanding fees. If you miss renewing it on time, you'll also need to pay a late fee. Your license will be valid once you've completed these steps, until the next expiration date. If you don't renew again by that time, your license will become invalid.

Except as provided in Section 2535.3, a license that has expired may be renewed at any time within five years after its expiration upon filing of an application for renewal on a form prescribed by the board and payment of all accrued and unpaid renewal fees. If the license is not renewed on or before its expiration, the licensee, as a condition precedent to renewal, shall also pay the prescribed delinquency fee. Renewal under this section shall be effective on the date on which the application is filed, on the date on which all renewal fees are paid, or on the date on which the delinquency fee is paid, whichever last occurs. If so renewed, the license shall continue in effect through the expiration date provided in Section 2535, after the effective date of the renewal, when it shall expire and become invalid if it is not again renewed.

Section § 2535.4

Explanation

If your license as a speech-language pathologist or audiologist in California expires and isn't renewed within five years, you can't just renew or reinstate it. Instead, you have to apply for a completely new license. To qualify for a new license, you must not have done anything that would cause your application to be denied, you need to pass any required exams, and you have to pay the necessary fees just like a new applicant. The board may also charge you for the cost of any exams they give you.

A person who fails to renew their license within the five years after its expiration may not renew it, and it may not be restored, reissued, or reinstated thereafter, but that person may apply for and obtain a new license if they meet all of the following requirements:
(a)CA Business and Professions Code § 2535.4(a) Have not committed any acts or crimes constituting grounds for denial of licensure under Division 1.5 (commencing with Section 475).
(b)CA Business and Professions Code § 2535.4(b) Take and pass the examination or examinations, if any, that would be required of them if an initial application for licensure was being made, or otherwise establishes to the satisfaction of the board that, with due regard for the public interest, they are qualified to practice as a speech-language pathologist or audiologist, as the case may be.
(c)CA Business and Professions Code § 2535.4(c) Pays all of the fees that would be required if an initial application for licensure was being made. In addition, the board may charge the applicant a fee to cover the actual costs of any examination that it may administer.
